Hello,

 

Can anyone please bring some light into my situation? I am confused by the travel ban on immediate family members-parent- of US citizens. My mother’s immigrant visa was approved in Dec. 2019 and is about to expire on June 12. I am flying to London tomorrow to accompany her to the US ( she is in a wheelchair and not speaking the language). According to the travel ban existing issued visas are exempt from the ban. Is that still true today? Anyone in a similar situation has traveled without any issues? I would greatly appreciate your inputs. Thank you so much.

Correct. Existing visas are exempt. Parents of a a USC are exempt from the 14 day presence ban as well.

Under section 2 (a)(iii) it appears this only applies if the USC is under 21

There are two orders in place.

 

One is a ban on immigration (supposedly in an effort to protect jobs for those already here) but your mother is excluded from this as her visa was issued before the ban took effect. 
 

The other is a ban on people arriving into the US who have been in countries with high rates of coronavirus within the previous 14 days (Brazil, UK, Schengen countries, etc). There are exceptions to this one but your mother does not fall under the exceptions as her USC child is over 21. 
 

She would need to spend 14 days elsewhere before coming to the US in order to avoid the second ban.

 

People flying in from London are mostly definitely at risk of transmitting, given that the UK has the second highest number of deaths in the world.

Do you have a younger maternal sibling that is under 21? If so, is he/she a US Citizen?

Dang....yeah, looks like she won't be able to enter on that visa unless she has an eligible relative (as your question alluded to), and she won't qualify for a replacement visa until the other EO goes away.

If OP had asked the question just a few days earlier it would have been possible. But potentially not feasible since OP mentioned she is in a wheelchair and spending 14 days in a foreign country (e.g. Mexico) might not be ideal. And it would have been a last minute scramble.

Hello Everyone,

 

By the grace of God my mom is here with me. After hearing what everyone had to say, I was worried, but I have decided that I am going to trust God with this. And I am so glad I did because had I not, my mom would not be here today. 
There was so much confusion so my husband thought to call the customer service at the Dallas airport and ask if my mom who had an immigrant visa, would be allowed to enter the country. They asked if this was her first time coming to the US and after my husband said yes he was put on hold for about one minute. The customer service agent got back and told my husband her visa was verified. But did that mean she was okay to come? At that point I felt like this was God’s way of telling us, “ trust me, go bring your mom home.” I am a believer and I prayed a lot over this matter, thus I have decided that if God brought us to that moment He will get us to the end of this journey. All this was happening at 9 o clock in the morning, the morning of my flight to London. We left home, got to the airport kissed and hug my family and was on my way to London. After arriving to London I had to spend around 24 hours in the airport until my flight back home. I could have left but did not want to be forced into quarantine or so I thought. So the morning of the flight from London back home, my mom met me at the airport. The checking at the gate was a very smooth process; a gentleman came and asked us a few questions concerning our whereabouts prior to that morning. They did not seem at all concerned with us being in England, rather if we visited any other places/ countries. Then they told us they needed to do a bit more research, took my mom into a room and swiped her clothes with some small stripes that went into a machine for testing. I never went thru that kind of testing so I did not know what to expect. It all took about 5 minutes and we were told everything was okay. So we were on our way to US. When we made it to the US customs the gentleman asked us what kind of visa my mom has and again, if we visited other countries. They fingerprinted my mom, after they took us to the waiting room until they checked her paperwork. After about  10 minutes they gave us back her passport and Hallelujah, praise the good Lord we were heading to the security and on to catch our connection back home.

 

There is no doubt in my mind that this was God’s blessing. Ever since we started this process we had friends and family praying for us, our church was praying for us, we were praying...It was like we had a whole army of God praying for us. 
 

This was a very emotional journey for me, especially after my mom’s stroke that left her impaired, just two months after we petitioned for her. I thought we were going to lose her, but she pulled thru. I could not bare the thought of her bot being able to come live with us. But God had other plans and I am grateful for that. 
 

Praise God! Now we can enjoy our life together.

Everything is possible with God!

12/08/2011-(Day20)-Text/Email received)
12/09/2011-(Day21)Check cashed
12/13/2011-(Day24)I-797C,NOA hard copies received in the mail(dated 12/08/2011)
12/30/2011-(Day41)Case transferred to another USCIS office for processing(don't know yet which office)
01/06/2012-(Day47)Received text/email that our case is being now processed to another USCIS office
