Impact of Tax Deadline Change to CR1 Interview?

My understanding is that typically we need to bring our tax return from last year to the interview if it's after Apr 15th. I'm assuming that this year we only need to bring one if we interview after Jul 15th? Meaning that we don't need to rush to file today for immigration purposes. Are there any rules from USCIS that requires the latest tax return after Apr 15th regardless of IRS deadline? Thank you!

USCIS states "most recent tax year" tax documents........this year the "most recent year" will be 2018 taxes....until July 15th.  After July 15th, "most recent tax year" will be 2019.  There is no specific reference to April 15th.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And while that is absolutely correct, it is BEST to take the 2019 tax return to the interview if possible.  If a Consular Officer ASKS to see it, it suddenly IS "required" in order to move forward.

For immigration purposes, the word tax return means form 1040 and ALL supporting forms and schedules, including but not limited to forms w2 and 1099.

CO can't ask for a person's most recent tax return and expect the 2019 tax return until after the IRS "drop dead date" .. which this year is in July.   

 

IF a person has filed their 2019 tax return before the interview THEN it would become your most recent tax return, regardless of the date

Actually, A CO can ask for anything they think they need, in order to make a decision.  For example, many people, particularly the self employed, routinely file extensions giving them until October to file the return.  Don't no what the deadline on extensions will be this year.  CO's absolutely do ask for tax returns under extension situations or at times NEAR but not AFTER the regular filing deadline of April 15, or so.  In these situations, the decision is DELAYED, until the request id complied with and the submitted documents are evaluated.

 

It's NVC that won't ask for a tax return before what you are referring to as the "drop dead date".

Yup, the CO could ask.   And he could ask for the kitchen sink from the house too ... 

 

But for the majority of those completing the process .. there is NO reason to rush and file the 2019 return just to have it "in case the CO asks"

I agree with your "majority" sentence.  I was responding to your use of the absolute term, "can't".  They CAN and DO, particularly when the sponsor is self employed and (There is every reason to expect.) particularly THIS YEAR.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
