Well corona closed down my job. Im worried if I apply for any government assistance, that it will affect our k1 application (waiting for medical and interview to finish). I've never had assistance before but it might get down to the point that I might need too. Do you think they will be strict about this even though it is a world wide pandemic?

No one knows how they will adjudicate cases of government assistance from COVID-19. We will have to wait and see. I recommend that you do what you need to do to survive and if that means using government assistance so be it.  I pretty much think they will understand. So be well. Do what you need to do for yourself and let's worry about this once the embassies reopen and start interviewing.

I agree. I have a strong opinion that the USCIS will make lots of exceptions just like how they extended the RFE dates recently. They've made exceptions, exclusions, and extensions for things in the past, and hopefully they'll do so again because these are unprecedented times.

Its not the government assistance that will bite you but if you are unemployed then you aren't a qualified sponsor.   I'd worry more about getting re-employed than using any assistance

It will not be held against him.

If still unemployed at the time of the interview, they will need either sufficient assets or a co sponsor.

Oh okay. Thanks. I know when this is over, my job position will be back but hopefully this isn't a long time issue.

I spoke with my employer about my specific K1 issue and they offered to give me a letter stating that my job is secured when and if I get furloughed (hasnt happened as of yet but who knows). It may be worth it for you to try and get a letter in the event the interview comes up before you go back to work. IMHO it might show the CO that you are still employed and are concerned, obviously, enough to put forth the effort. just my two cents.  Cheers and good luck!

Under normal conditions your last sentence has merit but things are different now so you're of the opinion that "nothing has changed" when it comes to proving finanancial assets? I am not sure how they will adjuticate this portion of the interview. What say you?

For the I-134 / K-1 visa, all one has to do is convince the CO that they will not become a public charge. So technically income (or sufficient assets) is not required, although I would think it would be incredibly risky to rely on an expectation of future employment. I'm not saying no COs may be satisfied, but I do think it would not be the norm to say the least.

 

For the I-864 for AOS, there is a minimum income requirement that must be met for even consideration. Under that = no AOS.

Given that the only path the CO is to consider would be that AOS is filed within 90 days (if they believe you are to overstay, they are not supposed to issue the visa) of entry and most people enter shortly after the visa is issued, it would be pretty lenient on the CO to accept the above.

Again, not impossible, but pretty lenient and not something I would rely on. I would absolutely suggest a co sponsor. You can always drop the co sponsor for AOS if employment is obtained by then.

 

I would not feel comfortable myself or advising somebody to continue with the K-1 process without a solid financial plan for support after arrival in the US (either a solid co/joint sponsor or actual income/assets to support them). Way too many people got burned by relying on future plans, and it hurts everybody in the end (especially the alien...so many horror stories).

Good to remember that London allows a K1 to self sponsor.
