A polish friend is worried. Is a I-539 plausible right now?

Hey guys,

 

A friend is here on a b2 visa and she’s afraid she won’t be able to go back  to the EU because of the current ban or that she will accrue unlawful presence  days in the US.  She’s aware of the I-539 but knowing how USCIS works, I wonder if it will give her enough time to be processed. She has authorized stay until

early May.  
 

Please advise. I trust this community a lot because I know you know your stuff.

She will be able to return home. The borders are not closed to the nationals or residents of that country.

 

This pandemic is no excuse to overstay. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Thank you for your response. She’s not looking to overstay at all that’s what she wants to avoid.  But she’s a polish National with residence in the Republic of Ireland therefore, her concern.

Timeline

Every country I know of is allowing its citizens and permanent residents back. She will have no problem going back. No excuse to overstay.

She can return home, wherever that is, and should do so immediately given what’s happening with flights. She’s not going to get anywhere applying for an extension arguing she’s stuck when she’s still able to travel, imo. ...She can always take that risk if returning to the US in the foreseeable future isn’t on the cards for her, but if she’d like to keep visiting then risking overstay makes no sense.
 The i539 woild not be adjudicated before her stay expires.

What exactly is the concern about this? She’s an EU national of one country residing in another.

As a citizen of Poland she can go back to Poland or as an resident of Eu to Republic of Ireland. Both countries will let her enter. It is her choice.
