2nd thoughts about K1 AOS

Timeline

It depends on the state you are going to reside when you get to US. Some people are getting their green card withing 3.5 months now and EAD and AP are being produce withing 2 to 5 months.

I am coming from Dubai. I work for ABB which is a multinational German engineering company. You might have heard of it. 

 

Well my intention would be to marry my fiance which is what I'll be doing. Isn't that the point of the K1? I wouldn't be going for tourism purposes or going to not get married.

is this the company? why not apply for a transfer if at all possible, they have an office in New Jersey, if you are working there, perhaps they can give you a letter showing that you are transferring and would need to work asap for an expedite?

More specifically, the USCIS policy manual states (https://www.uscis.gov/policy-manual/volume-1-part-a-chapter-5)

Quote

1. [^] Severe financial loss to a company means the company would be at risk of failing.

2. [^] The need to obtain employment authorization, standing alone, without evidence of other compelling factors, does not warrant expedited treatment. 

 

But yes, you can request with jut an offer. Just that footnote 2 says the need to have it alone won't warrant approval of the request.

Timeline

My EAD just got approved yesterday with no expedite. 3 months total. So i would just marry asap on the k1, sent in AOS packet a few days later (assuming you get your marriage certificate that fast like we did) and 3 months later (give or take) you'll be working. You can use that 3 months to volunteer etc which is what I did to pass the time. And I already have a job offer that I will start the day my EAD arrives in the mail (late next week i assume)

My K1 visa interview - April 3, 2019 = APPROVED!! :D       EAD & AP approved - Feb. 6, 2020

Visa on hand - April 8, 2019                                                      EAD/AP combo card & SSN card in married name received - Feb. 13, 2020

US entry - July 31, 2019                                                             Green card interview scheduled - August 11, 2020

Our wedding day - Oct. 14, 2019 ❤️                                        Green card interview - September 10, 2020 = APPROVED! :D

                                                                                                       Green card received - September 16, 2020
