Validity of Police Clearance

Hi - VJ members,

 

While I am waiting on NOA1 (still early in the process), my foreign fiance is mulling over obtaining police clearance report, since this will be needed later. Does anyone know what is the validity of the police report? My fiance said it's only valid for 3 months, but he's not sure. If there's no expiration date, then I would tell him to do it now and keep it.

For immigration purposes it is typically one year

Will the uscis know what country u have been to I'm having issues getting police certificate from a country I visited since 2007? Thanks

USCIS does not care. They just adjudicate the petition.

DOS will care. It must be declared on the DS-160 (non-immigrant visa application). They will also see it in the passport or during checks. Do not hide it.

I've lost that passport a while now and have a new one will it still matter and can over staying in another Caribbean country affect my k1 process or approval?

Nope, no issue with a new passport or overstaying in a country other than the US.

If I  just visited Egypt for 2 weeks on vacation , do I need to get a police report from Egypt ?

Always defer to your consulate's instructions if they state otherwise.

Since it must be maximum 6 months old when submitting to the NVC, and a maximum of 1 year old at the time of the interview, I would wait. Either way, obtaining it in Austria is relatively straightforward.

 

EDIT: sorry, I thought this was for a CR-1 visa, rules might be different for K-1.

If your fiance has previously lived in another country and is now not living there anymore and not planning any visits they can already start the process of getting the police report. However for countries where they still live now or plan on travelling to while the k1 process is ongoing the validity period will be important at the time the embassy requests the police reports so I would wait before requesting it.

They also can be different for each embassy. So OP needs to be careful. I advocate to have time sensitive documents prepared as close to the interview as possible.
