Hello, 

Im going to apply for a spouse-based green card in late February 2020 and plan to travel internationally in mid-January 2020. I’m originally from Croatia, with a Croatian passport and F-1 visa that expires in June 2020. Would traveling to Mexico for vacation “jeopardize” or make the process of filing for a green card in late February more difficult? Would you recommend to travel a month before getting married and filing for a green card? Thank you!

I would not recommend using a non-immigrant F-1 visa to enter the US with the intent to immigrate by adjusting status for a green card.  

 

Your F-1 visa is a non-immigrant visa that requires you to have non-immigrant intent each time you enter the US.  Upon entering the US after your Mexico vacation, you intend to immigrate by filing to adjusting status for a green card.  This puts you in direct conflict with the purpose of the F-1 and therefore, you could be deny entry into the US because of having immigrant intent and using an F-1 visa.

I concur - you cannot re-enter the US with intent to stay/file for AOS. That would be a violation of your visa terms.
