I spoke with the family law folks and they were focused on one thing dicorce... I'm trying to find other attorneryd who may be able to find a solution that allows me to let my wife travel with my done to Phillipines and ensure that she has to come back with him after x amount of time. Philippines does not recognize parental child abduction as a crime.  We are still married we don't need a divorce we need something to make me feel comfortable with getting my son a passport knowing shes not going to do something irrational. Does anyone know an an attorney that could help on this or has anyone dealt with this before? She just needs to get home for a while but things went sour when I said the timeline was too long.

It's hard to repatriate children from countries where is recognized... so, not sure what you think a contract would do.  Money deposit to be returned when the child is back?

What you are asking for does not exist. The lawyer doesn't care if the letter will work or not. He gets paid for writing it.

If things are not good with your spouse trust your gut do not get a passport.

If you're just paranoid then go with them.

Yeah... I'm going to agree with others here and say that go with your gut feeling. And there is no such document (or contract) that you are seeking. Also, be aware that the Philippines almost always automatically grant mothers maternal rights to children so she may be protected under their laws if she decides not to return.

I like the idea of a deposit held in ESCROW pending return.

Yes that's where we're at now she's just going to have to accept that she can visit there on her own for a while. How can parental kidnapping not be a crime in a country? I read a few news articles on father's that didn't know or acted to late.

Not to mention that a Philippine court will side with a Filipino 9 times out of 10 all day long.
