Moving back to UK with Husband?

Hey everyone. Last year my husband and I completed the K1 Visa process and I moved from the UK to the USA and we got married. 

 

We’re both becoming increasingly uncomfortable living here for reasons involving healthcare, lack of friends/family, Politics etc.

 

how difficult would the process be for us to move back to the UK? I’m a UK citizen and we’re married so I wondered if that would help the process.

Timeline

The question is if you want to keep the door open to coming back to the US or not. If not, for you its about as difficult as booking a plane ticket. This is probably the wrong place to get advice on immigration for your husband to the UK

No problem for the UK citizen. You would need to check with the UK for the process on moving your non UK citizen husband to the UK...especially with Brexit going on. He has to have some type of Visa just as you did to come here. If you choose to come back to the states then you would have to apply for the spousal visa

Timeline

The UK process is generally considered quicker and simpler. Will you be going back first to get a job or do you have the assets to sponsor?

The hard truth about the process is, green cards are for living and mostly remaining in the US. Moving to another country will abandon your process, making everything you went through for nothing, and eliminating the option of potentially being a dual citizen. If the thought of that does not bother you, then you'll have a bunch more obstacles to clear.

 

The US is not a member of the EEA/EU. This means freedom of movement is restricted and the US spouse has little rights. With Brexit around the corner this will become further complicated and full of uncertainity. There is a process for returning to the UK, and you can check out the link in my signature for that. These rules could change in the future, but for the majority of persons the rules are difficult at least on the financial side of things. US/UK couples don't often realize that when starting their relationships - and this is why I often advise, if you're moving to the US, you better be in it for the long haul or at least until citizenship... and if you really want to move back be prepared for a multi-years long process that is not easy.

 

The UK citizen must return to the UK and re-establish themselves alone. Obtain a job working the stated amount for a certain period or have the stated amount in savings. No cosponsors or assistance or money can be used from the US spouse. Only if you pass that test, will the US spouse be considered to enter. Even then, they cannot work for some time and there will be a health surcharge. From there it a continuing multi years process to establish residency. The application process for the UK is of course much faster than it is here, but the requirements can be a burden for some.

So since that would never be the case coming this direction, best to go through the process and marry in U.K. and remain there?  I find no reason to doubt your numbers other than their absurdity.  I work in the US and would continue to do so even after we move back there - which we PLAN ON after my daughter is grown, so a decade.  These are our plans.  Meaning no fraud going on.  We have zero intention of staying here.  But I have zero intention of working in the U.K.  so she don’t need a job and blah blah.  I guess I’ll just ‘visit’ my wife 10x a year when I fly back.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There is no legal way to marry in the UK and remain there without going through their lengthy immigration process, and that process is the same quoted financial figures. As for the rest of the post I'm a little confused as to your plan. There is no way for a USC to live in the UK legally without going through the process and providing the UK government what they ask for. Perhaps things will change one day.
