Posting for friend here. Could the following situation jeopardize their AOS process?

F1 visa holder marry to U.S. Citizen overseas, and then come back file AOS with a copy of marriage certificate from abroad.

Entering on a F1 with the intent to Adjust would be fraud.  They could marry overseas, file the petition stateside and do consular processing.

Not a fraud if they can prove their marriage is bona fide. We don’t know the whole story.

Entering on a non-immigrant visa with the intent to immigrate is fraud.

The word 'fraud' is tossed around too easily on boards like this. Nobody is talking about lying about anything, but, yes, they could be accused of fraud if they had met before the visa was acquired.

 

Talk to a local immigrations attorney about your best strategy towards immigration - one whom you're willing to discuss the entirety of your circumstances with.
