N400 October 2019 Filers!

I intend to file 3 years by marriage N400.

1. Still married but dealing with a very controlling and jealous spouse who is threatened by how much progress I will make by becoming a USC. I dealt 3 years with financial irresponsibility on his part such that we dont file taxes together. He always go ahead to file and takes that to travel round the world leaving kids and all responsibilities with mama.

2.Can I go ahead and get my citizenship out of the way? I became due last month but still contemplating. Take note I dont have access to his original naturalization certificate but have a copy to send.

3.Should I just wait for the 5 year rule?

He is unwilling to cooperate on this one.

Need advice.

Also, I moved from the West Coast to the Midwest and changed my address with USCIS, but my I-751 is still being processed in California. If I apply for N-400 now, what are the chances of my I-751 being transferred? 

Also, how do we request the combo interview? 

It's up to you. Some people prefer to wait others don't. Depending on where you are in your ROC it may delay or speed things up. The ROC needs to be done before they can fully approve the N400. If you are "stuck" in the ROC process, filing the N400 may get the file moving again (from an office where it has been collecting dust to an office that works on your N-400). But it is also possible that they are ready to hammer out your ROC and the N-400 application forces them to move it to your local office. If your local office is not fast you are looking at delays.

 

I filed it because I haven't heard anything from them in over 60 days after my ROC interview. My case status history tab only shows "received application" on one site and "received RFE documents" on the other side. As it appeared that they had lost half my file somewhere between Vermont and Texas, and than lost some more stuff between Texas and Norfolk, I figured I might as well file the N-400 to see if I can get things moving again.

I just submitted N400 now.   uscis website says 12 to 18 month. hope its faster than that. at least I could do it online make it easier. will update the bio and so on.

10-22-2013 - Sent out application package (I-130,I-485, I-765, I-131) with USPS priority express guarantee delivery on 10-24 ( Thursday) by noon

10-28-2013 - Got email/text notification for all four applications (I-130,I-485, I-765, I-131)

11-04-2013 - Received Biometric appointment notice for I-485 and I-765 on 11-18-2013

11-18-2013 - Done Biometric appointment

11-27-2013 - I-485 Status changed to Interview and Testing

12-19-2013 - I-765 online status changed to Card/Doc. Production, I-131 Approved, status change to Post Decision

12-24-2013 - I-765 online status changed to Card Mailed. without tracking number.

12-27-2013 - Received EAD/AP combo card in mail

03-26-2014 - Email/Text Notification Interview Date scheduled on April 29.

04-29-2014 - Interview at Salt Lake office, 15 min, Approved.

04-29-2014 - Status changed to Card Production/Decision

05-02-2014 - Status changed to Card Mailed and will arrive on May 5th.

05-03-2014 - Received Green Card in mail earlier than scheduled.

05-06-2014 - Received Approval Notice letters for both I-130 and I-485

03-12-2016 - Sent out I-751 remove condition

04-07-2016 - I-751 Biometric appointment

11-14-2016 - I-751 Request for Evidence

01-26-2017 - I-751 Sent out respond for RFE

02-07-2017 - USCIS Ordered the New Card

02-10-2017 - New card was mailed

02-14-2017 - New card arrived in mail

Technically if you are still married to him and are eligible to apply you can. You gonna need  copy  of his birth certificate/ naturalization certificate and front  info  of his passport . divorce document if he was married before.

My biometrics appointment is not until Oct 25 however I won’t be able to make it because of midterms. So, I walked in at the ASC bellflower at 1:00pm but I was told to come back at 2:45pm for walk in. I came back and finished my biometrics appointment a week in advance. It is already showing in the website. Now, waiting for interview.

07/27/2016 Delivered at Chicago Lock Box with signature confirmation

08/04/2016 Both checks are cashed

08/09/2016 Received NOA1 via text for I-130 & I-485

08/11/2016 Received NOA1 hard copy via mail for I-130 & I-485 (I-765 is rejected, forgot to sign)

08/12/2016 Mailed I-765

08/13/2016 Delivered at Chicago Lock Box

08/15/2016 Picked up at the Chicago Lock Box with signature confirmation

08/05/2016 Received NOA1 hard copy via mail for I-765

08/19/2016 Received Biometrics Appointment letter (2pm at Bellflower location)

09/12/2016 I-130 receipt number still not working, I-485 worked for the first time and says "Ready to schedule for Interview

10/28/2016: EAD card being produced

11/03/2016: We had out interview in Los Angeles CA. Our IO said they don't normally approve on the spot anymore and she gave us a paper saying "your case is being held for interview". The IO also said she is new, therefore she need to talk to her supervisor. Additionally she showed us a pile of cases that is being held for review, so it looks like it will take a while to get an answer about our case.

11/07/2016: EAD card was mailed to me

11/09/2016: EAD card received. Applied for SSN, needs verification will take up to 4 weeks.

11/10/2016: went back to SSA office with my unexpired passport, got verified right away.

11/10/2016: SSN card received

12/28/2016: I-485 status updated to "New Card Being Produced",later in the day updated to "Case was approved"; I-130 status updated to "Case approved"

(1 month, 3 weeks & 4 days after the interview) & (5 months & 2 days after filing AOS)

1/03/2016: Receive I-797 approval letter for I-130 & I-485; status updated to "New Card Being Produced"

1/04/2016: Welcome letter received; status updated to "Card was Mailed"

1/06/2017: 2 year green card received :D

How long is wait for you for 5 year rule?

Sometimes Its safer and not raise red flags if you file as 5 year. Depends. 

I am not filing threw my marriage even I am married 5 years already I am gonna apply as 5 year rule. 

 

01/14/2020 - filed N400 Miami FL

01/18/2020 - NOA Biometric scheduled 

02/05/2020 - Biometrics done 

03/13/2020 - Interview scheduled - canceled due Covid19

08/19/2020 - Interview 

08/27/2020 - OATH Ceremony MIAMI FL 

Done with USCIS  !!!! Good luck everyone!
