Hello, I have a quick question. My spouse just  received the NOA2 last week, so being excited we spoke to our immigration attorney about the next steps - who consequently shot our excitement down saying it will take around 8 months from now. 

 

Anyhow my dilemma is 8 months from now I’m out of country for work for 3 weeks. So if the interview at my local embassy (London) is scheduled around April 2020 is it set in stone? Do I HAVE to attend the interview at that time or can it be schedule for say in May or something? I’m not sure how the process works from this point onwards.

Estimated 8 months doesn’t mean exact 8 months. Your interview could happen in Feb 2020 or June 2020. It depends on how the backlog is cleared at the London embassy. You can reschedule but the new interview date could well be 4-6 months far. So don’t scratch your head thinking about that time. Focus on assembling documents required for NVc.

8 months seems a little long. It’ll be 6-8 weeks for NVC to receive and input your case. Then you kinda control how fast it is by having/submitting the required documents. When all the docs are received, maybe 1-2 months for the interview to be acheduled

Okay cool. Thank you! In terms of documents for the NVC do you mean my spouse documents in terms of finances etc? And for myself birth certificate, police certificate etc?

I hope it’s sooner rather than later. It would be good if I was out there by next March time that would be absolutely perfect!! I’m looking on the NVC website right now (travel.state.gov) and im looking at the steps involved. It seems pretty straight forward. I want to start getting all my documents together now, any idea where to start?

One of the things that have changed is that I think today most people upload the document direct to the NVC. No sending in papers anymore.

Here are some timelines for the UK sorted by interview date. Maybe it can give you a better picture of how long it takes from NOA2 to interview? It also, of course, depends on how quickly you submit everything at NVC stage. From the little bit that I saw on the timelines, most seem to be way under 8 months, and could also very well do with dragging the feet at NVC or not

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Seems like it’s takes average of 4-5 months with 6 months the longest I’ve seen. Some are around a year but I presume something went wrong in the application.

To give you an idea...I went though the London embassy 3 years ago. Same visa type. Got my NOA2 at the end of July. NVC stage was complete by late October. Interview was December 6. I moved here on December 19. 

 

You have six six months to come here from the date of your medical. So if you want to continue working in the UK until May (you mentioned going away with your job in April 2020) you need to make sure your medical is later than November. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

So what I’m most afraid of is having the interview schedule for while I’m away in April (or just before I’m away as they’ll have my passport). Cause if I push back the interview I hope to god they don’t give me another slot like 4/5 months away.

If I have my interview anytime in march or earlier I’ll be okay. I’ll just fly from USA to wherever I need to be. 

I have all my papers ready and my wife’s papers are ready too so we can just scan them in when needed!

 

Your timeline seemed pretty quick, but I understand things have changed now.

The NVC will go as fast or as slow as you make it go. If you have all your documents ready before you even get NOA2 for the I-130 (as I did) then you can really race through that stage. The waiting list for appointments in London is small to non-existent. But you can slow things down at the NVC and delay sending things. If anything, things have sped up since I was at the NVC as we had to mail everything by UPS/FedEx back then and my package was held at customs for several days but now applicants use the electronic file uploading system.
