Timeline

Hi everyone,

 

We sent my husband's AOS packet on July 29th and it was delivered July 31st. His K-1 Visa just expired yesterday (August 15th) and we have not received any receipt numbers or NOA1 yet. Is he now illegally in the country? What are we supposed to do? Is there any way to know if they even received the packet from the post office or whether it is lost? Is anyone else still waiting for their NOA1s?

I actually just called the USCIS and they informed me his application was rejected for being filed improperly. I am at a loss for what to do. I guess our only course of action is to lawyer up and hope ICE doesn't come knocking.

His K-1 expired as soon as he entered the country. It is a one time use visa. You don’t need a lawyer, that would only slow you down further and cost more money.  Are you still within the 90 days of arrival?

07-17-2009 I-129F sent

07-22-2009 NOA1 date

07-24-2009 check cleared

07-30-2009 NOA1 received via snail mail

10-14-2009 NOA2 (we were around #187 on Igor's List)

12-30-2009 Interview in Madrid!

02-01-2010 Visa in Hand - finally!

03-08-2010 POE Orlando, FL

As long as you got married before the 90 days then youre fine. Everything else is at your own pace and control. The K1 visa expiration date is the date he needs to travel to the USA.

I suggest submit AOS documents again, you still have chance. check more samples how to do it properly. It is September already,  Maybe You already did it right. Good luck!
