Hello,

 

Please can someone clarify, I have applied for CR1 visa. Once I move to the US do I need to apply for Green card separately?

 

Also from my understanding, we dont have to wait to receive the employment card, the stamp on the passport should be enough for employment.

No. You just need to pay the Immigrant Fee (before or after POE).

For employment, yes. But you will need an SSN for payroll, so it's best to stop by the SSA in person sooner rather than waiting for it in the mail later.

For AOS from a K-1, that is correct.

 

Despite this being the AOS from K-1/K-3 forum, though, we occasionally get posters who are adjusting from other types of visas.

Hey Geowrian,

I needed advice on AOS, this might be off topic but I couldn’t send you a private message. For the AOS, If a sponsored immigrant works and receives means tested benefits in the same year that he/she works does that mean that the 4 quarters obtained from work don’t count as “qualifying credits” to end the i864 contract because they received let’s say Medicaid for example? Thank you

You cannot count a credit for I-864 purposes for a quarter in which certain federal means-tested benefits are used. See https://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-2872/0-0-0-3055.html:

(o) Termination of Sponsor’s Obligation and Enforcement .

The obligations created under Form I-864 and I-864A terminate when the sponsored alien:

 

·     Becomes naturalized;
·     Is credited with at least 40 quarters of employment in the Social Security system;
·     Loses or abandons his or her lawful permanent resident status; or
·     Dies.
 
Note  
For any qualifying quarter to be creditable for any period beginning on or after December 31, 1996, the alien must not have received any Federal means-tested public benefit during that quarter. A Federal means-tested public benefit is any public benefit funded in whole or in part by funds provided by the Federal Government that the Federal agency administering the Federal funds defines as a Federal means-tested public benefit under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (Pub. L. 104-193). Federal means tested benefits include: SSI (Supplemental Security income), TANF (Temporary Assistance for Needy Families), food stamps, Medicaid, and State Child Health Insurance Programs (SCHIP).
