Medicaid for Conditional Resident’s Family

Hi! So before I asked my questions, I would like to tell give you a few details so my question will make more sense :)

 

-My husband came here through the K-1 Visa, we got married 1-2 weeks later, our child was born 2 weeks after that and a year later (last year) he got is conditional green card approved.

 

-My parents were our sponsors when I sent the Fiance Visa Petition as well as the AOS (since my income wasn’t enough my parents had to be the co-sponsors.)

 

My question is: Can my child and I get Medicaid even if my parents are our co- sponsors? And Can my child and I get Medicaid without it affecting my husbands Removal of conditions for his conditional green card?

 

I know a Resident can’t get any type of government help till 5 years after he’s become a resident. My parents are our sponsors and as sponsors they have to care for us financially until we are financially stable. We live with my parents right now and my husband has a job and we Filed our taxes as married but since my husband got his job, we don’t depend on my parents financially anymore. I just don’t want to get Medicaid and then they somehow end up making my parents pay back the $ cus they’re financially supporting us even though they’re not anymore. Is this all possible or am I just really nervous and stressed that I am overthinking? My husband’s insurance doesn’t cover much for him & our child so we want to get Medicaid for my son so it can at least cover my sons appointments.

Not true.  This is not the scope of the co-sponsor of an immigrant visa.

 

You and your child can obtain any means-tested benefit for which you qualify without consequences to your husband or parents.

 

Edited to add:  definitely get Medicaid for your baby.  Health care costs for babies during the first few years can really add up, and it is better to have as much coverage as available.  You may also qualify for the WIC nutrition program, which is an excellent program.  Most cities and towns have multiple WIC offices.

The child can get Medicaid and am I pretty sure that you can as well in Oregon. Since you are a USC then you can get it without affecting your spouse.

This was discussed recently and unfortunately hijackers.  I’d cite the reference but it would just result in more hijacks. 

 

Bottom line is that as USCs, your child and you can collect Medicaid, food stamps, welfare etc and it doesn’t affect your alien spouse.  Nor his financial sponsors.
