Is it possible to extend the stay on a tourist visa?

Yes she told me today that an attorney told them to apply for an extension so he can be present for the birth of his child. I’m not sure the attorney is correct or if they are just trying to collect fees.

It is possible but difficult - some of my relatives tried in the past but none got approved.

This will likely backfire on them. She is barely 2 months pregnant and his extension will likely run out  if he got one before she delivers. If the extension gets denied he will not be allowed back to visit. Best if he returns home now and comes back closer to her due date.

I was also thinking that it would be better if he returns and comes back and was questioning the attorney's advice.  I think it is a waste of money.  His visa is valid through July, so if extended, it would last through the birth, theoretically.  However, I think it is better for him to leave and return.

bear in mind that if he is denied the request after his original i94 ends and he has remained in the US beyond that date under CoS pending, any overstay is calculated back to that date and his original visa will be cancelled immediately.

Even if files an I539 (not recommended), he doesn't need an attorney to file it. If the attorney tries to convince him legal help is needed for success, then just make payment contingent on a successful application and see how that goes down.

An extension is fairly risky. First, it takes several months, anywhere from 4-6, for i539 adjudication. It may be approved, sometimes for less time than requested, OR denied, OR lately, RFEs seeking details on all travel and activity since that i94 admission. A denied extension leads to cancellation of the visa and unlawful presence. A lawyer is not required, i539 is fairly straightforward. 

 

An extension is usually not really worth the risk if the visa is expected to be used later.
