How long does it take to expedite an EAD for K-1?

Timeline

We filed my wife's Adjustment of Status for her K-1 visa on December 8, 2018 (received date: December 13), not long after we got married.  This week, she was offered a teaching job for the upcoming school year.  The start date is late summer.  But the school needs to make the hiring decision official by the end of their school year, which is coming up soon.  It's a fairly specialized teaching position at a private high school with high academic standards.  She meets their standards, but not a lot of other teachers do.

 

According to VJ, USCIS is now processing EAD requests (for K-1's) from several weeks after we filed.  So we filed an expedite yesterday.  We just sent her job offer letter and said that it will be a significant financial hardship for us if she can't start this job.  The expedite request currently says that it hasn't been assigned for processing, although it has only been a day and it's the weekend now.

 

How long do the expedite requests for this take?  And is the lack of the EAD going to block her from starting the job, assuming that it does come before her start date?

June 2016: We started writing to each other

08/15/2018: Our case reached NVC

08/22/2018: Received NVC case number

09/04/2018: Our package left NVC (arrived 9/11, and she sent packet 3 that day)

09/20/2018: Received packet 4; scheduled interview

10/30/2018: Interview - told that we're approved!  Now waiting to receive the visa...
11/27/2018: Port of Entry at BWI

12/1/2018: Our wedding!

12/8/2018: Filed AoS on the way to our honeymoon (12/8-15/2018)
6/~7/2019: EAD and AP approved
09/25/2019: AOS interview in Orlando -- approval and green card!

Next step, June 2019: Filing I-751

 

Note: My wife is a Singaporean.  She moved to Australia before we met and got permanent residency there.

Check my timeline for exact dates and times of my expedite request it is in the EAD section. I somehow managed to get EAD and the AP card in less than a month from my request. It takes about 2 weeks to get the letter for extra information, then you fax your evidence in, they review it and either approve or deny the request. My wife had her card a week after I faxed everything to them, but the thing is I don't believe my request had anything to do with the issuance because card was being produced before I faxed the information in. I think I just got lucky because my wife received the EAD and AP combo card, not just the EAD I requested an expedite for. My online USCIS profile still says nothing about cad issued, delivered or even if they received the information. Just today I checked and nothing has changed. So I can't speak on if it worked or not, but the times from application to returning my evidence are there, and yours should be similar. We had severe financial hardship due to her needing emergency surgery, check my recent posts and you will see the information on that and why I requested an expedite. Am I understanding you correctly that you submitted your AOS/EAD/AP concurrently last December 8th, non-expedited, and recently expedited the EAD?  What with the recent unusually protracted processing times, it is difficult if not impossible to even kinda predict when applications/petitions will be adjudicated, regular or expedited processing. According to US immigration laws, yes , she will need to have her EAD prior to accepting the job. Some of the initial employment questions at most employers specifically ask about immigration status. You may want to make an Infopass appointment at your local USCIS field office, explain your situation to the Immigration officer. Perhaps they can tell you where the, now expedited, EAD application is in the processing. It is worth a try, don't know if it will work.

So you already received a request from them, for additional information, and you already sent it off? 

 

If so, on average it takes 1-2 weeks for them to review it, and if approved, another week or so to receive the EAD in the mail. 

 

However, there isn't much rhyme or reason to it, and it cool take less time or more time. Some people wait longer. 

 

Either way, I don't see you not having an EAD for the late summer. I don't see why she can't sign a contract today, as long as she doesn't actually work until she gets her EAD. It's perfectly fine, the only possible issue is the employer wanting to e-verify before she starts work, but as long as they're willing to wait a bit, it's not an issue.

Hello guys!!

 

We just recently received our K1 Visa & we are planning to get married in July. I’m trying to plan ahead. What steps should I take to get the EAD the quickly? I plan

to file the AOS in July with the EAD & AP. Is there any way to speed up Work Authorization?? Thanks in advance!!
