Hi Everyone.

So my husband & I went through financial difficulties the moment I got here in the US via K1 Visa, so we weren't able to file AOS. We're married for almost 2 years now, & I'm worried that once we file for my AOS we'll have issues or whatsoever. We're slowly getting back on our feet & we're definitely happily married.

Question is, should we just wait until we're married for more than 2 years to file for AOS, since i heard (not so sure) that I'll be getting 10 year green card instead of 2 year? Or is it up to USCIS what they will approved us for?

Will it be a huge issue to them if we weren't able to file the AOS as soon as possible?

Thanks is advance 🙏

Just file now. You will get the 10 year green card because you are married over 2 years when you get approved. As far as scrutiny sure I am sure you will get an interview. But not a big deal. Right now you are out of status and risk being deported so I would get it done now sooner rather then later.

And no it's not up to them to decide what card you get 2 or 10. It's about how long you are married on approval.

This won't be a big issue at all possible so please don't worry about it. Doing be surprised if they don't ask about it at the interview though.

We have had several cases here of people having to wait years before filing for AOS and it went smoothly for them.
