My daughter is still in the Philippines, but I'm petitioning my wife

Hi guys, so appreciate your quick and insightful responses to any questions I have had. Anyways, here is another matter I need help on.

 

My daughter was born in the Philippines in 2018. I myself am stuck in the US for now and going to try and petition my wife who is also in the Philippines currently. 

 

I know that for my daughter to come to the US she will need a report of birth abroad but can inherit my US Citizenship status? I will not be able to be there if I make an appointment to show them proof that I am the father. Will this be a problem if only my wife and daughter are present for the interview at the US Embassy in Manila? 

 

Going forward would it be best to just petition my wife first and while waiting get the report of birth for my daughter? Thanks as always!

Timeline

Consular Report of Birth Abroad shows your daughter’s inherited US citizenship. At our consulate in Vancouver, Canada, my husband (her US citizen father) was required to be there. Contact the consulate nearest your wife and ask whether or not you have to be there.

I think it did say I don't have to be there but it's strongly recommended. Maybe i should try to call and confirm. I am just worried it could hurt my chances of getting approved if I'm not there.🙄

You are NOT required to be there in Manila, but depending on circumstances (how long you were there around the time of conception etc.) they may require a DNA test which can also be accomplished without you being there.

 

Your business as to why you are "stuck in the US" but the REASON can have an impact on your process as well, even if only in terms of not seeing your family for a long time.

Facts are cheap...knowing how to use them is precious...

Yeah my passport will show that I was there living in the Philippines at least 1 year before she was born and about 7 months afterwards until I returned to the US. 

 

Yes they will want to know the reason I am not going to be there? Thanks.

The key is how long you were there before and after conception, not birth.  I didn't say they would want to know there reason you are not going to be there.  I said that the reason can have impact on your wife's process, not the CRBA.  Example.  You are "stuck in the USA" because you haven't paid child support and your passport is not usable.  They don't have to "ask" to know that reason on their own. 😉  Obviously, there are numerous other possible reasons you are "stuck".
