Adjustment of status

Timeline

Hello all.

My now wife who came on her K1on 26-Oct-2018 and we married 8-Dec-2018. We completed her adjustment of Status document with the I-765(work request) (we also had already went to the S.S and requested her s.s card right after our wedding) and I-864(affidavit of Support).

Her packet made it to USCIS yesterday. 

My question is: her I-94 expires 28-Jan-19. What happens now and what if USCIS doesn't process her Adjustment of Status before Jan-28?

Once you two got married and filed for the AOS then she is fine. You do not have worry about her I-94 expiring.  So please calm down and you will be fine.

yeah just an FYI getting AOS completed before Jan was never going to happen, total time takes 8-10 months from what I understand and that is from the day they get it and you get NOA1

 

new information you will get is for bio metrics, somewhere around 6-8  the EAP/AP card will arrive, and then scheduled for interview after that.

 

she will be fine no need to worry.

Cyberfx1024 is right, once you file the AOS she is covered until they reach a decision in her case.  If she applied for advanced parole along with the AOS, it will show on the employment authorization card and she will be able to travel outside the US if needed. Once you have her SS card, you should add her to your bank account and any credit cards.

Depends where their local office is and depends on their case.. some people finish their interview less than 3 months from the date of filling aos.

 

As of OP concern they have nothing to worry about even their i 94 expire. They already file aos so they are fine.

What happens now is you wait. First for a biometrics appointment then for the EAD/AP then/or interview.

They won't process her AOS before the end of January. Well...maybe they will by the end January 2020. Could be sooner or later than that depending on local office, but many are taking around a year.

She has authorized stay while the case is pending.
