I got a job offer, can i apply for expedite ?

Timeline

We have 3 i-130’s at Nebraska processing center. Still waiting for NOA2 and living in Canada with my spouse and two children. Back in my home state i got a great job offer where we are planning to move once this whole process is over. Would i get approved if i applied for an expedite ? 

 

How do you apply for an expedite ?

Possibly. You won’t know until you try. But be prepared for the answer being “no”. There’s nothing to stop you moving back ahead of your spouse in order to take the job. You would’nt be the first or last family that has endured separation during this process. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I’m not sure if you can expedite your case but leaving before the petition is adjudicated will help you establish US income for the support affidavit.  

It’s either that, a joint sponsor, or show them enough cash to overcome 3X the income amount for household size of 4.

It also establishes domicile....Canada is strict on domicile.

Probably not but you can try.  I suggest taking the job however and establishing domicile and helping yourself with the affidavit of support.  It's not like you can't visit, but I do understand it can be expensive and difficult if the two places are far apart.

What would be the basis for the expedite request?  You can go now and take the job as a USC, no waiting at all for you to go immediately.  USCIS or the IOs don't care about separation of families, many of us are in that boat and we just endure it.  So I would say little or no chance of an expedite approval but you can always try.  I saw a recent expedite approval for I-130 but it was to bring a spouse living abroad to the US on an I-130, based on financial hardship reasons, to reunite a couple so that the husband could work in the US and live with his wife and kids, but even then it only shaved off a couple of months of waiting.  So it depends on the circumstances and the decision of the IO reviewing your request.  Good luck.
