Timeline

Had only N-400 interview @Philadelphia and passed , obviously decision could not be made.    I-751 ( VSC EAC 18061XXXX from Nov 20117) is pending and it is not a combo interview.  Now waiting game.

I just stumbled across this thread... I have an N400 interview on the 22nd, and i 751 still pending.

My situation is even more complicated as my USC sponsor abandoned our marriage a few months after I applied for n 400. She had severe mental issues, and spent the last year of our marriage in and out of mental wards.

 

I have called and written to USCIS about both  cases, at one point i was told they'd be adjudicated at the same time, at different times that they were two different processes. I felt hope when i was told about the interview on the 22nd, but now I'm starting to have doubts again.

 

Looking at the notice i got, (and only got one) it's only talking about N 400.

 

I don't suppose anyone has been in a similar enough situation?

Unfortunately, your N-400 must be denied as you are no longer eligible under the 3 year rule. One must remain legally married until the oath under the 3 year rule.

You are free to reapply under the 5 year rule, once eligible.

I'm sure you're right, but what's frustrating, is that every time i call, or even speak to the actual officers (at infopass), they give me contradictory advise.

 

even this forum does. I literally just tonight decided to search for "N 400 separate from i 751 interview" , and came across all these threads talking about how they had n 400 first, and had to wait for i 751. Where as  (and I don't wish to start a thread-war ;) ) every other n400/i751 thread, says there's "only combo" interviews. 

 

not to mention that I in one of my tier 2-3-4 w/e requests, got notice that they'd be adjudicated at the same time.

 

 

It's just so frustrating how one can't get straight answers from anyone.

I get the frustration and I hope things work out for the best. It's not easy....I 100% get that.

In addition, some spousal naturalization provisions require that the applicant “live in marital union” with his or her citizen spouse for at least 3 years immediately preceding the date of filing the naturalization application. [19] USCIS considers an applicant to “live in marital union” with his or her citizen spouse if the applicant and the citizen actually reside together.

An applicant does not meet the married and “living in marital union” requirements if:

  • The applicant is not residing with his or her U.S. citizen spouse at the time of filing or during the time in which the applicant is required to be living in marital union with the U.S. citizen spouse; or

As for the interview, it may or may not be a combo interview, hence why you see different results. Generally they try to adjudicate both the N-400 and I-751 together. It's easier for everybody that way. However, sometimes they don't get linked up together so they may schedule separate interviews. Sometimes the I-751 is first and sometimes the N-400 is first. If the N-40 interview is first, they will not be able to approve it until the I-751 is approved.

And I'm not saying you're wrong, but in some of the other threads I was part of, in regards to n 400 / i 751  / divorce  etc. you would've been chewed out for just saying these things.  Which is why when I mentioned the one agent talking about two different processes, I got inundated with "negative feedback". ( Some might've been trolls, idk.)

 

It's just I didn't get a i 751 notice. That case hasn't changed on my online portal since i think it was transferred to Lee's summit. and even that, one of the tier 2 was saying that it got transferred back to CA that same day.....?

 

but the one enquiry i did , i got (in writing) the result that they'd be adjudicated at the same time. so i assumed that the VJ ppl were right, and that the one (or technically 2 ) officers that said there would be 2 processes , 2 interviews, were wrong. (or maybe just wasn't update with 2018/19 processes, as I'm from a smaller area , w less immigrants , of this country.)

 

I guess as much as it's nice to follow online forums, and find like-minded pp, sometimes it's just false hope and the blind leading the blind. I mean, I guess I don't know that my i 751 (nor n400) will be denied. but if my wife has to come to the interview, she won't. I haven't talked to her since she left the marriage. (my lawyer told me not to reach out to her, so  I didn't.) 

And where as ... very colorfully , some VJ members said there would be one interview, that what mattered were the 2 years pre i 751, 3 years pre n 400, no need to send in i 751 waver / update... (which i couldn't even do until only about 2 months ago, 2y 3mo into waiting for i751 and 1y3m into waiting for n400)... where as now i'm reading in other forums that that I only had so long to even send in the i 751 waver. (and technically I called tier 2 on the day my divorce went through , and they said to wait. that was about 2-3 weeks before i got my n 400 interview notice.)

 

 

I guess I'll see on monday. There's really no time to do anything right now.

 

 

and is this paragraph something new? because I literally spoke to a N 400 officer on my last infopass appointment in march, and even he wasn't clear . First he said it was until the oath.... he thought... then he said ; "but wait, don't withdraw your application just yet.... i'll have to look into this."

And that's the guy administrating the interview for n 400!

So you understand:  We applied 751 in Mar 2017.....Applied N400 end of Jan 2018...400 bio's in April and Nov 2018 interview test for 400 and 751 combo, which was a pleasant surprise!

There has been cases here on VJ where people go in for their N-400 interview only to be told to go home again because the i-751 hasn't been processed yet. That's what makes me hesitant to file the N-400 before having the i-751 approved first. 

 

I wouldn't want to be sent home without an interview or anything, at least OP seems to have had his N-400 interview. I doubt we'd all be that lucky.
