You still have to prove bona fide marriage even if you choose the abuse waiver on the I-751. And if the husband didn't abuse her then it's not even an option.

Reading through the rest of this thread It does sound like immigration was more on the forefront of her mind, rather than a loving marriage, when she married him.

 

Also quite possible the husband had an inkling of this in the beginning, which might explain why she was never officially added to bank accounts, billing, lease, etc.   

 

Doesn't sound like it was an abusive marriage....and it also sounds like the conditional greencard might not have been properly approved in the first place

 

Assuming she initially crossed the border on a tourist visa, overstayed, and then married a USC.....how on earth did she pass the AOS interview if she wasn't living in marital union with him from the get-go???   How did she prove that, even though they were living separately soon after marrying (which is not the issue as couples can live apart temporarily for various true reasons)---how did she prove they were still in marital union with no proof of co-mingling of finances at all? Unless their separation was never disclosed to the AOS interviewer...but still boggles the mind as to what evidence they presented back then to prove a bonafide marriage when going through the AOS stage.
