Hello,

 

Our I-130 petition was approved and has been sent to the NVC. My question is simply, does the NVC expect us to provide more evidence of a bona fide marriage since the time of the filing of our I 130 petition (January)? I ask only because it seems redundant, considering the USCIS has already processed that part. Furthermore, we provided probably more than what was necessary (daily emails exchanges and skype calls months before and after  our marriage, dozens of pics with friends and family from both sides, receipts whiles living together, etc). In fact, I had to send a package/box, instead of a thick mailer.

 

Any input would be appreciated.

We sent in more evidence of bonafide marital relationship after submission of i130 petition under other supporting documents.

You can send in additional documents to NVC if you wish, or you can take it to the interview with you.

No they don't; FWIW, when my file reached the NVC, I only sent what was asked for at that stage.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The NVC does not require any evidence of a bona fide marriage for their part of the process. They are only concerned with gathering the required eligibility documents for the applicant in preparation for the interview - they want to see police certificates, passports, birth certificates and other legal documents along with the required financial documents. 

 

In some cases it can be argued that it's worth sending additional evidence to the NVC as everything they receive pertaining to the case is sent to the embassy so you are using the NVC as a mail service to get stuff to the embassy. If the beneficiary is from a high-fraud country and the couple had had additional face-to-face meetings since the petition was filed, it's worth sending this to the NVC to strengthen the application. It's not worth sending photos, message screenshots, "chat logs" or other forms of secondary evidence, especially if you have already sent a bunch of this. That would just be a waste of paper and postage fees. It would only be worth sending something that could have a significant impact on the chance of approval.

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I’ve got a lawyer and when she told me no evidence was needed to send to NVC I freaked out! We didn’t send any and I kept seeing people telling me to send photos, chats etc... I got CC after 7 days! So it’s up to you really but definitely bring all you’ve got to your interview! Good luck 🙃🙃
