My mother in law has Pancreatitis and is in and out of ICU.

 

We at the case where we are approved since June and the NVC haven’t received the I-130 as yet. 

 

My lawyer applied a temporary visa for me so I can take my daughter to meet her grandmother for the first time, this is my mother in law only grandchild and she want to meet her grand daughter.

 

Thursday I had my interview for a temporary visa.

 

The Guy asked why do I want a temporary visa and I said why.

 

and I was told I over stayed 8 months from October 2013- June 2013. I ask where? The guy said look in your passport, he realized he have it and went through my passport and still couldn’t show me where I overstayed.

 

I was working at the time also I look in my passport after I left because I know I never over stayed my time.  They maybe don’t want give it to me because he think I will not return home since he saw where my case is being processing.

 

 

Last time when I sent for my B2 Visa last year they said because my case is processing I have to wait for that to be completed.

 

My passport didn’t show I overstayed and I don’t know why he have to make up some kind story like that to try make me feel like I over stayed. 

 

Said I can’t get the temporary visa cuz I over stayed 8 months when it only allow up to 6 months.

 

If I know their rules only allowed up to 6 months when why will I over stayed more then 6 months. 

 

All I know is I never overstayed my time and that it.

 

 

some people at the Embassy’s are careless and don’t have a heart.

I'm not sure why he checked your passport for an overstay...the US doesn't issue passport stamps (or have any immigration counters) when you exit the US.

Check your I-94: https://i94.cbp.dhs.gov/I94/

 

Either way, I'm sorry to hear about your story but their decision is what it is. Best wishes to both of you.

yes they do have immigration counters stamp  on the passport. least mine have it.

 

I agree it is what it is.

 

I tried the website and it said

No record found for traveler.

Is this with the US or another country? The US has no exit counters. Or maybe you are referring to the entry stamp (which has an I-94 stamp stating when you must exit by, but nothing about when you actually left)?

I have seen other people have trouble pulling up their I-94, but if the travel was fairly recent (since 2013 or later?), it generally pops up. Odd.

Not sure what you mean by "temporary visa". Sounds like it was just B2 tourist visa application. Either way, can't really do anything about it now.

sorry I mean another country which is my country  (The Bahamas)t shows when we return home. the Embassy here in the Bahamas they know.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

sorry I should have put the whole thing on here but when I say temporary Visa  its B2/medical treatment mean. like you said nothing can be done.
