I130 wife kids and stepkids

If you are a green card holder can you petition your wife and her kids on one single application? And can i add my kids from previous marriage to that same application or should it be on a different application?

Only US citizen can file a petition. Green card holder can't file petition

Not true. Green card holder can apply for spouse but it takes 2 years.

wife and her children, your stepchildren can be on one i130 if they are minors as long as you are a resident until they come.

 

the child from a previous marriage will need to be on a separate i130

FYI for future reference, https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/family-based-immigrant-visas.html:

  • IR-1 is for Spouse of a U.S. Citizen
  • IR-2 is for Unmarried Child Under 21 Years of Age of a U.S. Citizen
  • F2A is for Spouse and Unmarried Children Under 21 Years of Age of a LPR

The number of Immediate Relative Immigrant Visas issued is Unlimited. But the number of Family Preference Immigrant Visas issued is Limited (thus the longer wait).

Hi, I was looking at your timeline and then I reread your post. Now I'm confused: Who was approved for a visa on 2018-07-19? And did that person enter the US already?

On a different note, the following is important info to be aware of, https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/family-based-immigrant-visas.html:

Important: If the family second preference (F2A) petition that you filed for your spouse included your minor children, now that you are a U.S. citizen you must file new and separate petitions for each child. This is because children cannot be included as “derivative applicants” on a parent’s immediate relative (IR) visa or petition. (This is different from the family second preference (F2A) petition, which allows minor children to be included in their parent's F2A petition.)

Yes he is in the us already. But this id a diffrent case im asking for my uncle and he is a green card holder not a citizen.

Okay so one application for wife and her kids

And another one for his kids from previous marriage. I dont believe they have kids together.please correct me if im wrong

I didn't understand the last sentence

 

but the more people you file for, the more you will need to make or find a joint sponsor

 

you will be responsible for them to not become a public charge

 

plus for the other children, the mothers or tutors of the children will have to authorize you to take them out of the country to live with you

Yes he understand that.

His wife and her 2 kids 

And his 3 kids so we are talking about 6 people.

 

Okay so my uncle has 3 kid, and his wife has 2 kids 

And he wants to bring them to the US. He is a green Card Holder. 

 

Can i do one application for his wife and her 2 kids?

And then another application fot his 3 kids?

Send them all in one packet with 2 separete filling fees.?

If im missing something please explain

his wife and her 2 kids yes, they are derivatives of their mom, so they all go on one 130

 

all other 3 children must be filed separately, so in total 4 130, one i130 for each child and one for spouse and her children

 

a minor child can't be a derivative of another minor child, the main beneficiary must always be an adult, a spouse or an adult unmarried child with children

 

son he needs four i130 and that's just the beginning
