10 year statue of limitations on old tax debt

I have old unpaid tax debt from the 2008 tax year. I recently learned that there's a 10 year statue of limitations by which the IRS can no longer go after you for debt that old. 

 

Now, my question is, since I'm applying for citizenship, does USCIS still care that I paid that debt off? I've been considering paying it off in full. It's only a couple thousand dollars, which I have in my savings.

Were you making payments on it?

If not, it may be an issue for the Good Moral Character (GMC) requirement, even if it becomes no longer collectible. It is outside the 3/5 year filing window, which is good, but that doesn't negate it either.

I'm actually surprised that the IRS would allow a collections case to go on for 10 years.  They have almost absolute power in collection authority.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Okay, so if I pay it all in full right now, will I be okay?

 

No, I did not have an install agreement. I wasn't making payments on it. But I can pay it in full right now.

Paying the taxes now because you want US citizenship doesn't erase the last 10 years where you didn't bother to deal with your overdue taxes.  Paying now does make this go away in determining your good moral character.  The only reason for you wanting to pay is to get something in return.  That's how this looks.  

Suggest you get professional help from an immigration lawyer to deal with this.

No one said any of that.  

 

You want good answers to your questions, then go hire an immigration lawyer.  No one here is going to be able to answer these questions for you based on one thing, your overdue taxes.

I forgot to add that during those years, or since those years passed, I did not have an income. I did not have a job. I have a job now, which is why I can pay it now.

When it comes to applying for citizenship, unpaid taxes combined with lack of documentation proving that you have the intention of paying it would definitely hurt your application. Pay your taxes, get it over with and then you may apply for citizenship. Also, have an explanation letter ready at the time of the interview describing why you didn't pay your 2008 taxes until now. That's where you may talk about not having a job.
