Second RFE for form I-864, joint sponsor requested

Timeline

Hi everyone! My husband's IRS 1040 income for 2017 did not meet the 125% of poverty guideline. Now USCIS is requesting evidence from a qualifying joint sponsor which we don't have. No one is willing to help. I was wondering if we can send additional documents about my husband's new income instead. He got a new job in May, a stable one. Would a letter from the employer, 3 months pay stubs/slips, life insurance certificate etc suffice? Any answers would be greatly appreciated!

I have no idea but I would definitely try it. I’ve heard of them bending the rules sometimes. 

 

Someone was living out of the country, didn’t  have any form of income. In the end, they were approved based on a future letter of employment.

You could try that; but since they specifically have asked for a qualifying joint sponsor, that is what they want to see. Regardless of current situation when going into this the details and requirements were known and should have been prepared for.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I would send a revised I-864 and all that info you mentioned. Also a note saying you don't believe you need a joint sponsor any more since your husband's income is sufficient now.

You can only send them what you have. It sounds like the new job should be sufficient. At the same time, with 2 prior RFEs for the I-864, they are unlikely to issue another one if this is insufficient, and would more likely deny the I-485 this time around. So having a joint sponsor would be recommended. If that's really not possible, then send what you do have. Good luck.

I agree with others; it sounds like it would be sufficient. But it is also risky because this already is your second RFE. If finding a joint sponsor is not an option, I would include any assets you may have.

While this may be true, this can also hurt the petitioner/applicant.

 

If USCIS requests further evidence of proof of sponsorship, they are ensuring that the applicant will not be coming to the USA to end up a public charge for the US government....that is the true reason behind having a qualified sponsor who is 125% above the poverty threshold. 

 

I understand OP mentioned no one else willing to help but sometimes things are beyond our control and we just have to accept these things.

 

I really hope everything works out in your favor OP.
