So let me make the long story short. I am a Moroccan and I just moved to Germany. I met my wife two years ago, we have just got Married in Denmark. She visited me  in Morocco and we have pictures with the family and stuff. The problem is that I have applied to a F1 visa and got it denied as well as the fact my brother lives in USA. In addition to this, there is an age gap of 20 years between us. The question is how am I going to overcome all those red flags. I do have plenty of evidence but I think that’s never enough. How long should I wait to apply for CR1 after the marriage ? Are two visits enough, especially in our case? Which kind of evidence do I need to enhance my chances ? What are the points that I should focus and work on?  I do ask couples with the same or almost the same experience to share with me the tips they have used.

On what basis or grounds did you move to Germany? Work visa/permanent residency? You must have a legal status (not just visitor visa) to apply and process through that country otherwise you would have to go back to Morocco for the interview.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Are you in Germany legally? 

 

If you applied for an F1, got married in Denmark, living in Germany - it gives the impression that you are doing anything you can to get out of Morocco. 

 

How long were the visits for? 

You can apply for CR1 visa any time you choose to. Most get denied at the consular level - not USCIS, but if you are legally in Germany your case could be processed through Germany, not Moroccan consulate. 

 

Generally two short visits, getting married quickly, and a 20 year age difference would make it hard to be approved through the Moroccan consulate. If you want to spend 6-12 months with your wife at whatever country you choose - it would be easier. They will ask questions like did she meet your family, did you meet hers, does she have children you met, etc. 

 

We cant make your decision on when to apply CR1 - you know your situation better than us.

I am legal in Germany. The first visit was at about 15 days and the second is 10 days. Because of the fact that none of us has enough vacation to travel to Morocco we decided to get married in Danemark.

It’s a training visa, which lasts three years. It’s not a visitor visa

Then technically you should be able to process through the embassy in Germany.... now, that being said, will they take into account that you're a Moroccan citizen and apply the same standards as the Moroccan embassy would? Can't say for sure honestly. The 20 year age gap and only couple visits are main red flags of the typical cases we see here on VJ. Also don't know how the embassy in Germany even would look at the 20 year ago gap. They may not care or they may see same thing as the Moroccan embassy would.

Well if the CO who interviews you is familiar with Morocco K-1 applicants, you might have some trouble. Odds of that are low though. I think you have a OK shot. You've known each other for 2 years, but how long have you been married? And you've spent a total of 25 days together? How long have you been in Germany? I know you have a 3-year visa, but much longer will you be there? If you're close to the end of those 3 years, you might have a more difficult time. Pure speculation on my part though.

Why K-1? I want to apply for CR1 . We have just got married. 10 days ago. So far I have spent one year. After three years, I can stay here, that’s not the problem.

They are comparing it to a K-1 as that is main denial cases for Moroccans. People then think that just marrying and doing a CR-1 "fixes" things and they will get approved which isn't the case. Marriage guarantees nothing. Don't think anyone here can specifically answer how the embassy in Germany would evaluate your case honestly. USCIS for the initial petition will approve most likely; but it's up to the consulate to make final say and how they will view it all I can't say personally. So it's more you and your wife's choice about filing now or waiting and having more visits.

 Sorry, error on my part. Disregard that part. I think you have a pretty reasonable shot at getting a visa. Good luck, and congrats on your wedding!

Ha, yes, thank you for explaining why I brought up the K-1. I knew I had a reason behind that comment!

Forgive me if I'm missing something but is your wife a USC or an LPR? If so, I believe she is the one who would have to petition for a CR1 since your are the beneficiary. Why are you in Germany instead of Morocco? Furthermore,  why did you get married in Denmark instead of Morocco or Germany Sorry, but your post is confusing. Thank you for clarifying.

Sorry, but your post is confusing. Thank you for clarifying.

My wife is a USC. She’s the one who is going to petition for CR1. I am in Germany for a training. Due to time, we were not able to go to Morocco and get married over there. As for Germany, I think only a native German would know how difficult it is to get married in Germany. ( Bureaucracy)
