Hello. My wife is well beyond the time she has been eligible for citizenship, and we are pretty much ready to do it.

 

The issue we have is some of the supporting documents. We can literally supply everything we need to prove our marriage is legit, including 3 years of tax transcripts, but we have a lack of financial ties documents. In 2017 we had to make an extended emergency trip back to her country to take care of her I'll mother and this caused us to lose our bank account after debts auto hit and we could not afford to keep up as she had to leave her job and it was just my disability benefits supporting us and her family over there.

 

If we can supply and abundance of evidence showing our marriage is still very well intact and legit and we have not been separated one moment un over 5 1/2 years, would bank account and financial stuff be necessary? My benefits are deposited into my moms account as she used to be my fiduciary and she receives a paper check.

 

Also, is debt an issue with immigration? We fell heavily behind on bills the few months we were over there and dont know if it will hurt her citizenship application.

6/26/2014 - I-130 Received and signed for at USCIS

7/1/2014 - E-mail of acceptance with Receipt number - NoA 1 (Routed to California Service Center)

07/15/2014 - Change of Address via phone call with USCIS, confirmation via e-mail.

09/04/2014 - Expedite Request response - Must enter Beneficiary Date of Birth - Re-sent exact e-mail with requested info

09/10/2014 - Expedite Request e-mail received as "Under Review"

09/11/2014 - Expedite Request Approved - Confirmation via e-mail from U.S. Embassy in Bucharest, Romania

09/16/2014 - Embassy Received Case from NVC

09/16/2014 - Received E-mail from Embassy to Schedule our Interview and prepare documents

9/23/2014 - Medical Exam at Regina Maria - Results OK

10/01/2014 - Visa Approved!

10/03/2014 - Received Passport with Visa!

11/2/2104 - PoE Atlanta - Welcome to the US!

11/5/2014 - Paid $165 ELIS Fee

8/1/2016 - I-751 Packet sent in for Removal of Conditions!

8/15/2016 - Notice of Action 1 for I-751 - California Service Center

9/29/2016 - Received Biometrics Appointment

I would be more concerned with her physical presence in the US requirement.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I believe there is a calculator you can find online to figure out your days in and out of the US specifically for seeing if you qualify to file for citizenship, a quick google search should find it. I wouldn't worry to much about the dept aspect, I have seen posts where people had filed bankruptcy and other financial hardships but still got naturalized. I would recommend that you start an application online. There is a section where you account for where you lived, worked, went to school, were unemployed etc. while in the U.S. and another section where you account for when you were overseas and for how long. It will tell you if you meet the residency requirement.

 

You will find there is far less scrutiny filing based on 5 years of residency vs. 3 years of marriage.

 

Once the system determines you have been in the U.S. for 5 years, then by default you are put in that application category.

 

At the end of the application you will see a collapsible checklist and different categories of supporting documents. The acceptable file formats will also be listed.

 

You are not required  to submit online  right away; just keep the application active by signing into it periodically,  and either revisit your responses or upload supporting documents as they become available.

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

She is not eligible for the 5 year rule, only the 3 right now as she's been here since 2014. 

 

I guess my main question, is debt an issue with immigration?

I don’t think debt is an issue unless there is a court order due to debt and you ignored it or that you owe the debt to a government agency. In fact debt can be evidence of financial commingling and living together if it’s in both your names and joint address. You should also try to get some evidence of living together. Even if you don’t have a joint bank account you should be able to get a letter or a statement from the bank of account closure and all the previous statements. Also joint life insurance, health insurance etc can be useful

With current laws you can have section 8, food stamp, all sort of welfare, including no job for 5 years, you will still successfully be naturalize without any issues.

USCIS also don't care about your debt outside of Uncles sam . As long as you owe nothing to IRS, or state . You are fine...
