The K3 visa stopped being available February 1, 2010 because of a new policy put in place at NVC.  That policy became moot recently, when USCIS started closing I-129F spouse petitions BEFORE approving them, taking NVC out of the mix.

 

An I-129f is a petition to file.  It is not something one "applies for".

Ahhhh gotcha,

 

My F2A went to CSC and everything there is 20+ months, upon closer inspection, it turns out they do not do IR-1! 

 

Texas Center does it and their times are 6 to 8 months!

 

So quick question:

 

I am pending USC and expect it to be done by oct - nov based on Dallas FO times. 

  1. Does this mean that USCIS will transfer my case over to TSC or another center when I upgrade it to IR1
  2. I assume it wont have a "new" PD and the June PD I have for her will stick ? That means she could very well have an approved I-130 by end of the year! under the 5-8 months starts again when it reaches new center.

 

Thanks for the clarification, I had skimped over the times for CSC (and bundled all visa type/category into) and never realized in past 2 months that CSC does not do IR1 as it does not show times for it! You just saved me a few dollars and hours or time to prep 129F. 

 

My wife is gonna be happy!

You'll file your petition with Phoenix or Chicago lockbox and they will decide where to send it.  IR1 is a visa.  USCIS doesn't issue visas.  There is no transfer based on upgrading from LPR to USC.  USCIS approves the petition at the service center it is sent to by the lockbox facility and then sends it to the National Visa Center which is part of the Dept. of State.  USCIS is part of Dept. of Homeland Security.

Facts are cheap...knowing how to use them is precious...

I understand that, I already filed. It went to California since at the time of filing it sits as F2A

What I meant was me upgrading the petition from spouse of LPR (quotas) to spouse of USC (no limits and waiting for visa availability,)

Reason I asked specifically is cause CSC does not show processing times for I130 for spouse of a citizen. So my understanding would be they would delegate that file to a center that does which is every other center

Here are my details incase anyone searching for similar situation:

 

I-130 - June 2018, Filed as F2A

Went to CSC, processing times are 22 to 24 months for F2A. 
Based on this ETA would be Sept 2020 +/- 4 months for NVC

 

N-400 July 2017, Dallas FO

Filed with aid of Lawyer (paper), Processing time are 13 to 17 months.

ETA for this is Q4 2017, there have also been reports of Dallas FO picking up pace, recently people with april-may 2017 PD have been getting interview scheduled letter, so it might be sooner too.

 

 

B-2 DS-260, July 2018

Applied as wife has vacation time off, worst we get denied and we are out of USD 200, She will fly back for consular processing so she can say proper good byes back home.

 

 

 

Based on this I have already started filling out the I864 and I485 forms, already got my tax transcript too!

Fixed DS-260 to  DS-160

 

Its correct, just maybe a bit confusing

Dec 2017 - married in India

 

March 2017 - Filed taxes as MFJ, got my wife an ITIN number.

 

I-130 - June 2018, Filed as F2A (for my wife)

Went to CSC, processing times are 22 to 24 months for F2A. 
Based on this ETA would be Sept 2020 (+/- 4 months for NVC)

B-2/DS-160, July 2018 (for wife to visit)

if She gets denied, she is applying for Canada visa as I want to be near Texas in case I have to fly back for interview or oath.

 

There is a section in the form for visitor visa asking if you have an active/pending immigration petition filed on your behalf.

Provided the above info in a brief concise manner (except the canada part)
