Hi, everyone.  I have a really unusual question.  A couple of years ago, I brought someone to the USA through a K1 finacee visa.  Unfortunately, it didn't work out, and she wanted to return home.  This happened before we were married.  However, even though she maintained contact for a little while, she' been acting strangely since she left.  She's been extra secretive.  I happened to stumble across a new Facebook page of hers that shows her in the USA.  At first I thought she just managed to come back... but now that I think about it... I'm wondering if she never left in the first place.  Her flight back home included one stop within the USA.  I'm thinking it may be possible that she decided not to board her connecting flight and never went back to her home country.  So... now I wonder what legal impact that might have on me if that is the case.  Should I be concerned?

 None. You did not marry, you did not apply for any AOS for her. She had the responsibility to leave the US on her own before the expiration of her I-94 she received when she originally entered on the K-1 visa. It's on her completely. Also, because she came into the US on a K-1 visa through you, she cannot adjust status in the US through anyone else. Perhaps she is unaware of this and thinking she can; but she can't.

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Nothing you need (or can) do...she's on her own to return home (or not and face the possible consequences).

 

If you ever petition another fiancee or spouse, they may ask what happened, in which case you would explain the circumstances. You didn't do anything wrong...it's completely on her to return home.

She may have recently figured out she can only adjust through you and now she is slowly going to try to wiggle her way back to you. Sucker you into marriage and AOS then ditch you after she gets the card.
