A few k1 visa questions

cr-1 visa is for those who are already married right? i have looked a bit into that before and everything i was finding was saying that we have to marry in another country thats not in the usa, if i did go that route id like to marry him in the usa then go back home and then apply for the cr-1, is that possible?

Perfectly fine........it is visa fraud only if you enter the US via a tourist visa, ESTA, etc. with the intent to stay and adjust status after marriage.  Entering the US via ESTA, marrying, then returning to the UK to file is perfectly legal.  In fact, visiting the US for short visits during the CR-1 process is also fine.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

oooooo I see that changes alot, so with the cr-1 it requires the 125% right? and roughly how long is it to get approved? other than the poverty line is everything else the same in regards to evidence

It's pretty much the same, and yes I do believe you will need to show the proof of 125% poverty limit. It takes well over a year or so to get approved, but once your approved you will have your green card right away.

The CR-1 process is currently averaging 12-14 months from filing to visa in hand assuming there are no RFEs, etc.....and a CR-1 allows the immigrant to immediately work and travel outside the US.  It also eliminates the need to Adjust Status.

 

EDIT:  My wife entered the US via  a CR-1 on June 22, 2017.  She had her Green Card in hand on July 15, 2017.....only about 3 weeks after POE.

It does appear that this would be their best option, if they are ready for marriage this soon though. Have to factor in another trip together and plan a wedding...etc.

I plan on visisting him again august 2018 for 1 month, we would be able to get married then and then apply for the cr-1 when i go back to the uk ?

Yes, that would work perfectly...that gives you time to gather all the needed papwork, plan the wedding and get the marriage license! It's still a pretty short timeline though....maybe 4 months tops. If you do the courthouse marriage it won't cost much and it takes pretty much no planning. Then have a large reception for everyone to celebrate.

we planned on having a civil marriage, and then having a proper large reception marriage after a few years, would it seem bad to them if he proposed to me in august then we got married a few weeks later?, we have already been dating since august 2017
