Hi everyone,

 

I am panicking because it's almost time to send my i751 form. I am a conditional resident, married to my lovely husband whom I've known since High School. It will be my two year anniversary as conditional resident in July. We live in Texas and are both 24, and are still very dependent on our parents (financially). I am stressed out about the documents that we have to provide, which we do not have and cannot provide because we are still students. I work part time, he is looking for a stable job. 

 

The documents we have are:

Cover letter

Marriage certificate

My green card front/back

2 affidavits (cousin and brother in law)

Letter explaining our future plans 

Driver license (both of ours with same address)

Tax return 2017 including both names

Photos 

Pictures of concert including tickets

Receipt of upcoming event with both names 

Sam's club joint membership 

Gym membership (also joint)

 

We do not have and do not plan on having kids yet. We also have separate bank accounts because we simply don't wanna fight over money. Our parents pay our phone bills and we don't need to pay rent. What else can I include that we could provide in this short period of time? I'm in desperate need of some help.

You can only send in what you have, but you may consider getting wills and living wills for each other.  You can do these fairly quick and for a decent price online.

Honestly this doesn't look like much. Explaining to the USCIS that you don't have a joint account because you don't want to fight over money is not something that will give you any favor. Sorry, but marriage couple should kind of talk about money and plan their finances together... Anyway.

 

Joint accounts, joint bills, rent, medical or car insurance... Anything financial is the stronger evidence and you're lacking a little bit. I wouldn't be surprised if you'd get a RFE, but who knows. Might get lucky.

 

edit: I wouldn't even add concert tickets or such... Doesn't seem like a serious evidence.

Do you have the same doctor or dentist? they can attest that you are a family, show that you are both on an account (ie my dentist can print out billing that shows both our names and our upcoming appointments for me, my husband and son).

 

Also, a letter from your parents stating that you both live there in their home and are living as husband and wife

Catlover - just breathe for a minute.

 

First of all - let's think of what they want to see:  A) that you (physically) live together and B) that you do life together

 

So:  what things prove that you live together?

1.  A deed, mortgage, or lease, or, if you are living with family, an affidavit from the homeowner stating that you live with them, and will continue living with them until xxxx (time or event), and what they take care of for you (telephone, utilities, etc.)

2.  Things with the same address like driver's licenses, letters/bills from Sam's Club, mail addressed in both names, letters from your University(s) with the same address

3.  Medical/dental insurance cards/mail.  If you are still covered under student programs, that's fine - but surely you both get mail from them and it comes to the same address.

4.  Car insurance, or, if you are driving someone else's vehicle, your names listed as authorized drivers.

5.  Bank statements that are mailed to the same address (we'll get to the separate accounts in a minute)

 

What things prove that you do life together?

1.  Joint anything (Sam's Club, gym membership)

2.  Pictures - ESPECIALLY showing you with family members and close friends

3.  Concert tickets (especially if you have pictures of the two of you at the concert)

4.  Receipt of upcoming events with both names

5.  Is there ANYTHING monetary-wise that shows sharing?  Such as Person1 pays this every month and Person 2 pays this every month?  Even if you have separate accounts, if you can show that money is shared in some way, then do so.  Type up a paragraph with a description, and then cross-reference it to bank statements.

 

You should show 3 years of tax returns.  You can go to the IRS online and order "tax return transcripts"  (not ACCOUNT transcripts) for 2015, 2016, and 2017 (assuming you have already filed 2017).  The tax returns should show that you filed "Married, Filing Separately" or "Married, Filing Jointly"

 

And then, yes, you should attach a page talking about the fact that you are both students, you live with xxxxx, and they help financially.  That you have chosen to maintain separate accounts at this point, because, being students, you each need to have control over your own finances. 

 

You can only send what you have.  And remember - if they have questions, it just means an interview - not a flat rejection!

 

You have to tell your story with your paperwork.  And that story needs to stand alone.  If the story cannot stand alone, then you will be brought in for an interview.

 

Be strong!  And go for it!
