Timeline

DoS received the NOS. The update came today although the NOS was sent on Dec 18th and the received date is Jan 31st.

For the embassy you need the actual waiver. It's a green paper with the Statue of Liberty printed on it.

I think it's always a copy, because they keep the originals; kind of like a birth certificate.

 

FYI -- Yes, I have a green paper that is that form with the waiver. That's what I needed for my GC and H1B applications

The processing time for final waiver varies from weeks to months, so nobody really knows.

There is a website to estimate it (https://egov.uscis.gov/processing-times/) - I never use it so not sure how accurate is it.

 

For those who submit DOS favorable recommendation letter with H1b premium processing (like my case),

the final waiver will typically be approved within 15 calendar days.

Thanks for clearing that up for me. Everything went quickly so I was hoping the same would be for USCIS. My two years are up in September. Hopefully it comes before that.

Just an update for anyone it may help (because I know I've been slowly losing my mind over the past two months). I've been waiting since October 24th for a DOS decision on an NIH-sponsored NOS waiver. I emailed at the 8 week mark (generic response), 12 week mark (no response), and again on Monday as I had reached the four week countdown to my J-1 expiration date. On Monday, I also contacted my senator's office, having previously had no luck with my state representative.

 

I'm not sure whether any of the latest prods aided the process, but first thing this morning I received an email confirming that a favorable recommendation had been issued (not yet updated online). As soon as I receive the DOS letter, I'll be going ahead with H-1B premium processing, and it may still even be possible that there is no interruption to my employment.

Thank you! I had two J-1s. First was a 6 month short term scholar, funded by home government and hosted at NIH. I returned to my home country for 18 months so it remained subject to 212(e). Second was a full research scholar, of which the first three years were funded by NIH. I moved in my fourth year to a university, which allowed NIH to provide favorable sponsor views. I had two notable delays - firstly, my embassy provided some incorrect information about required documents and then lost my packet; second was at DOS.

Yes, you can do H1B with the DOS letter. I did that.

Hi all,

I sent my documents to DOS on Jan, 19th and got a confirmation from USPS tracking that the documents were delivered on Jan, 22nd.

However, today is Feb, 8th and there is still no update in the DOS portal that my documents were received.

I have seen in some of the timelines that others have shared in this thread that it normally takes around 2 weeks, so am a bit worried that my documents got lost somewhere.

Is anyone else seeing delays?

DOS didn't get a statement of reason from me and I sent one early in December. It took almost a month for them to update the portal even though it showed that they got it a few days after I sent it. Give them some time. Sometimes it takes a while.
