I have a question? and I truly hope this make sense

in 2013 I filed for my now ex husband in Mexico. We were doing the K3 visa then. I believe my lawyer filed the I-29F and I-30 at least that is what i see on the USCIS approval letters. His petition made it to Mexico for an interview with the consulate but never showed up because we were in the divorce process then finally on May 2015 we got officially divorced.  his petition has now been terminated after much struggle.

that same year in 2015 I meet my fiancé and file the K1 visa for him. But in 2016 We were denied the K1 visa for various reasons. 

 summer 2017 we married and now 2018 I am doing the CR1 evidence for my fiancé now husband who is still in Ghana. 

I am getting ready to submit my first CR1 for my current husband in Ghana. Don't Judge but I was scarred to be denied again so I prepared the most amazing evidence for a bona fide marriage. 

 

the question I have is?

Do i need to submit two waivers? one for my ex husband and one for my current husband since we went from a k1 visa to now a CR1 visa?

when I did the K1 visa for my fiancé now husband in Ghana I had to submit a waiver since My ex husband petition was still active and it was the second petition within 3 years.  

But now I am curious if I still have to submit a waiver about my ex husband petition from 2013? and if i have to do a waiver since I did the K1 and now doing the CR1 for the same person I might add. 

And if i have to do the multiple waiver then do i need to do two?  since they are two different people

can I combine the two? 

as you can see I'm a bit confused. Any help would be much appreciated.

PLEASE. I need help to hose who know how I can answer I-130 part 5 Other information.

I have filed for two different people. one is my ex husband in Mexico and the other one is my husband from Ghana.

My ex husband petition was withdrawn. a year later I met my husband from Ghana and we decide to do the K1 but we later denied. Therefore I am now doing the CR1 visa for my husband in Ghana and I am trying to fill out I-130 and it ask if I have previously filed for this beneficiary or any other alien. the answer is" yes" to two separate people. but it only gives me one space. whom shall I name first? my current husband or my ex husband?

should I use the additional space to put my ex husband?  basically whom shall I name first?

PLEASE I need help knowing if I need to do a multiple filer waiver for my CR1 visa or not?

I have petitioned for two different people since 2013-2017

my ex husband in Mexico who never attended his interview and later I revoked the visa.

my current husband whom I did the k1 visa for an were denied and now we are in the CR1 process.

therefore I have a total of two I-129 F petitions. and will have one more which will equal to 3 after I submit the CR1.

I am doing the waiver and based on what I have read this is as close as I believe to get? but yet it does not seem correct? will someone please help me?

To Whom It May Concern:

In compliance with the International Marriage Broker Regulation Act (IMBRA), I respectfully request a waiver on the filing limitations in connection with my current petition. A waiver is appropriate in my circumstance because I have no criminal history with regard to the “specified crimes” under IMBRA.

I have two prior form I-129F petitions filed:

  • JoseXXX, receipt number# LIN-XX-XX3-8XXX This petition was approved on December XX, 2013, and resulted in. the petition being withdrawn or revoked per my request.

  • EmXX, Receipt# WAX-1X-3XX- XXx9. Petition approved on November XX, 2015. Resulted in K1 visa denied and petition now expired.

Evidence to support this waiver includes:

  • USCIS Letter revoking JoseXX petition

  • Divorce decree for JoXX XX

  • USCIS Letter for EmmXX K1 visa expired.

  • EmXX and (petitioner) BXX BRXXs Ghana Marriage Certificate.

Thank you for your kind consideration of my request. I am sending this waiver so that my CR1 visa for my  current husband EmmXX  may not be interfered and to  help why a waiver is necessary in my case.

IS THIS RIGHT? or should I just name my ex husband in mexico since USCIS might know I am doing the CR1 for the same person I did the K1 visa?

has anyone ever heard of needing to do a multiple filer waiver for CR1?

I have sent many request regarding this question and I truly need help since I am wanting to submit my evidence ASAP but I do not want an RFE so I am wondering if anyone knows if I need to do a multiple filer waiver for CR1 visa?

No there is not.  But multiple CR1 and K1 will cause a marriage to be looked upon suspiciously.

You won't find any reference to multiple filers in the I-130 instructions.  You've studied those AND the actual form, right?  All your circumstances will be considered and you will be disclosing previous filings and results.
