Passed my Citizenship test but decision cannot be made.

Hi there everyone...early this month on the 9th I had my Citizenship interview here in Los Angeles and I passed all 3 test the IO was super nice but at the end she handed me a paper where it said that a decision cannot be made. Now I did have an DUI arrest in 2013 which I really regret and learned from so ofcourse I took care of all the fees and completed everything the court asked for. I also got it expunged once the 3 year probation was over. In the interview with the IO she did ask me about it and said she had to get it signed off by her supervisor. Has anyone been trough the same experience as me? Will I get declined? How long does it usually take? Any advice? Thank you.

If the DUI fell within the five year (or three year, if filing as the spouse of a US citizen) statutory 'good behaviour' period then it's possible you might be denied for demonstrating a failure of good moral character.

 

Right now all you can do it wait.

Hey Hypnos thank’s a lot for your reply!  The Dui  was in August of 2013 and yes I am married to a U.S Citizen. I really hope I get approved.

If it was in 2013 and you're applying under the three year rule then your DUI would fall outside of the statutory period, and wouldn't be held against you.

Do you have source on this? I thought being married only gives you one benefit of applying after 3 years. As far as criminal record goes, it has to be clean for the last 5 years regardless

The DUI was in 2013.....but your probationary period was not over until 2016.....hence why Hypnos brought up the GMC part.

It is possible a more stringent IO could deny you because it's been less than 3 years since the probation was completed....but most likely may approve you as well so long as your nose has been kept clean other than the DUI.  Good luck!

Update: So today I received a letter from uscis asking for additional information court disposition of my DUI arrest. I had sent a court copy of my case with my application which i thought that was it. Why are they asking for it again? Maybe I am confused and they asking for something different?

You sent a regular photocopy from your own records, or you sent the official court-certified copy with the raised seal (which is what they require with the application)?

 

What does the letter specifically say?  If you can upload it here (or type in what they specifically say in the letter) that would be helpful.

I sent a certified copy of my case from the court which I payed  a 25$ fee for .

Looks like they are asking for the same thing again.  Possible it got separated from your original application and they basically lost it (rare, but it does happen at times).  Get another final disposition (I know, it's a pain and it sucks, I've been in your shoes) and resubmit it, if you didn't order more than one copy the first time around.

 

Another suggestion would be calling USCIS and asking to be transferred to an L2 immigration officer (who can see your personal case details) and confirm with them that they never received it the first time/do not have it in your file in the very rare circumstance the document was overlooked.  Chances are he/she will tell you to submit it again or at least confirm that it's not something else they are asking for in addition.

It’s kinda weird because when I went for my interview it was there with my application, the IO went trough it. 

But yea I am going to call today just to make sure.

update: Today I received a letter from uscis denying my citizenship case because they never received the additional information they requested, which was  a certified court dipostion that I sent April 26. I don't know what to do now. Should I call uscis and explain to them that I did sent out that additional information they requested?
