Adjustment of status from ESTA

Timeline

Hello everybody, I've been with my Fiancee for over a year, I've visited her for 3 times, and we were planning to apply for a K1 visa. Also we were planning trips to Europe during the K1 process, But! Yesterday , and while we were driving at the airport we changed our minds, we cannot be away from each other. So, we've decided to get married and apply for adjustment of status. I have proofs that wasn't my intention to stay here, i have a very good job waiting in London, I rent an apartment in London and 4months ago I bought a car. What do you think we should do ? Thanks in advance

P.s i know all of her family members, we know everything about each other. Is not a rushed meeting.

Hope you're aware you can't work till you receive EAD and if you leave US before Advanced Parole is approved,  your AOS will be considered abandoned.

10/26/2018 I-485 case status updated to "We ordered your new card"

10/29/2018 Case Status updated to "We approved your Form I-485"

10/31/2018 Case Status updated to "We mailed your new card"

11/01/2018 My card was picked up by the USPS with tracking number assigned

11/05/2018 Green Card Received 

 

Side note: I turned my maiden name into second middle name. In the combo card, my given name is First Firstmiddleinitial, however on the back of the card, they attempted to list my second middle name.

As others have said, your decision to marry and file for AOS will have its consequences.  You can not leave the US or work for at least 3 or 4 months (when you receive approved Advance Parole and EAD). ....that's after you marry and file the AOS paperwork. There is no way to travel back to your country before then to tie up your loose ends like your job, your apartment, your job, and everything else you need to do.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I applied for my EAD (Work and travel) in August and still haven't heard anything :o

I’m confused. In your original post you said you changed your mind “yesterday” - but you applied for your EAD in August?

Oops, apologies - I didn’t check the poster’s name and confused you and the OP. My bad!

 

My EAD took 5 months so you should get yours any time now.

If you want to stay in the US during the process then an Adjustment of Status is what you'll need to do.

There are guides here on how to do it step by step and which forms to fill out and pricing etc.

 

You will not be able to work, leave the country or get a US drivers license until your EAD and Advanced Parole come through (assuming you apply for them, its optional but free) which takes around 4-5 months now. In my case the entire process, from applying for AOS to getting my Greencard in hand was 5.5 months (i also applied for AOS from visitor status), but that is not the case for everyone.

 

If not being able to work and leave the country is not an option for you then you could get married, return home and then apply for a CR-1. Takes around 12-14 months and you would arrive in the US with Permanent resident status and be able to work and fully integrate right away.

 

If you choose to go the AOS route, you will not need to gather information to prove your intent. What you'll need to do is gather information on the legitimacy of your marriage. Evidence of your relationship and how you co-mingle your assets as a married couple is what they're looking for. Intent is determined at Point of Entry and so it is no longer USCIS concern.
