I am about to start my I-864 (or the I-864ez).  I’m not exactly sure which one I should use, but I guess I will just do the I-864 to be safe.  My question, however, is how do I know if I need a family member to sponsor my wife (Korean citizen) or if I can sponsor her by myself.  I seem to find conflicting information everywhere I look and was hoping to get solid advice from people with experience.  Thanks in advance!!

Hi and welcome to VJ!

 

The main factors are have you established your residency in the US, do you have a source of income, if you've been living abroad did you file taxes in the US, and how much are you currently making annually (is this income in the US or will you lose this income if moving with her back to the us?)?

Thanks for the response!  Here are some answers, hopefully it answers what you meant in your reply.

 

1.) I am a US citizen and have a home (not transferred into my name yet, but will be when I get home.)

2.) I have an income at the moment as I am an English teacher overseas.

3.) I have filed my taxes for the last three years and have proof of all three years.

4.) I have made anywhere from $22,000 to $26,000 in the last three years here in Korea.  However, I already have a job in the USA when I get there making between $50,000-$60,000.  I assume if I can provide proof of this job opportunity, it will help.

Have you read the official instructions?

The qualifications for the forms aren't difficult to understand.

One requires a sponsor, the other doesn't.

 

Potential income does't prove anything, things can change, what gives you the idea what it will help?

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

Thanks, Mr. Hanky, for pointing out that I should read instructions.  However, that wasn’t my question.  My question was whether or not I can sponsor my wife by myself or if I need a family member to be the sponsor.  My income is from an overseas country, so that income will stop when we move.  So the question still remains, do I need to use a family member who has been well established in the USA as a sponsor, or can I still go it alone with the information provided in my previous response. My fear is that I will fill out the I-864 (or I-864ez) and I will have done something wrong and be denied.

Your question is clearly answered by reading the official instructions, it sounds like you're asking people to read them for you, is there something specific you don't understand in them?

 

Also I already mentioned potential income doesn't prove anything, they want to see what is real.

When will you start the new job? Is it guaranteed? If you could provide a letter from your employer with a start date & salary, then you might not need a joint sponsor. But, to play it safe, and if you already know someone willing to do it...then a joint sponsor would be good. They would also fill out an I-864...and if they file jointly with someone, then that person should fill out an I-864a.

Yes, the job is guaranteed and I would start as soon as I get back home to the USA. I asked for a letter because I have heard that helps in certain situations.  

 

As for the advice on the joint sponsor, that helps.  Thank you.  I don’t know if I would need a joint sponsor since my current income would stop and a new income would start immediately.  It seems like it’s better to use a joint sponsor of someone will do it.

Hi, have you read the instructions for both forms?

 

It tells you if you can use the EZ or not, read each one and see which you qualify for.

I read all the instructions when I did mine and it was fine, lots of reading.

 

You can't use something for proof that you don't have, the instructions say you need to provide your returns, that means the PAST not the future, nothing in the future is guaranteed, not even your marriage! lol
