K1 is Approved But We can't Fınd a Co Sponsor

Hi Everyone 

 

I am  a May  filer for  K1 visa .. our  Petition was  approved  in October  by  USCIS.   Now we are waiting to get a  case number from NVC. as a  Beneficiary  I started to collect necessary  documents.. Unfortunately accordong to  my fiancee's recent  W2  her income ıs insufficent to be able to be  fill out the affidavit of support ;  and so far we couldn't find a co sponsor...

but  My fiancee he has a two jobs now    and she has been working for full time for two months.. and she lives by herself .. I think she is making enough to support me.. 

 I will have K1 visa Interview at US Embassy Ankara Turkey.  I am wondering if  my K1 visa application  would be denied if we don't find a Co sponsor ?

Are you sure you are calculating her income right? With two jobs should be sufficient... But yes, you absolutely need a co-sponsor if she does not earn enough. They don't want you to be a pubic charge, meaning you would collect welfare, etc

It is a requirement that needs to be met in order to obtain the visa.

 

My husband brought my paystubs, past two years of W2s, and a letter from my employer stating I am a full time employee and how long I have worked with them to his K1 interview. You will need a co-sponsor or wait until she files taxes again (if she is making more money the upcoming  year).

If her current income is sufficient for the CO as a means to mitigate the risk of you becoming a public charge in the US, then no co sponsor is needed.

 

Tax returns are one aspect to show income, but carry more weight in non-wage earnings (i.e. self-employment, commissions, tips, etc.). There are some embassies that look at this more carefully, and I don't know Turkey that closely, but it doesn't ring a bell as being the case here. Pay stubs and an employment letter are the key items for wage earners.

My fiancé's last year's income is insufficent.. but her latest pay stubs is high now and she will get two employement letters.. I think  her current income is enough  to support  me.. I hope embassy  wouldn't  care about that much..

Will she earn a minimum of $16,240 this year?  That is all that is required for the support of a family of 2 for a fiance visa.  The amount goes up to $20,300 for the Green Card.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

That sounds perfect!!!  All you need to do is meet the minimum!  You are good to go.

Well, not entirely. Those are minimums...under that and you won't qualify. Over that, you may qualify. The CO looks at the totality of the circumstances to determine the public charge risk. Generally the minimums have been sufficient for visa applicants, but there are certainly cases where the CO has wanted to see income/assets above the minimum.

At what point does the 125% come into play?  Is that at the GC interview?

The 125% level is a minimum requirement for the I-864 (for AOS or an immigrant visa).

 

The I-134 is a tool for COs to help assess the public charge concern of a non-immigant.

Only the CO will be able to say for 100% certain based on all the evidence available to them, but it sounds like she will be fine.

 

Keep in mind that a W-2 shows past income...they want to see her current income. If she is still a wage earner right now, then the paystubs and employment letter will carry more sway to determine current income. Based on her current income being even higher now, I don't foresee an issue. :)

Unfortunately, that's a question really geared at your embassy. I would presume you can do the DS-160, pay the fee, do the medical, and schedule the interview since it shows that it's ready to schedule, but I cannot say for sure on the processes for Turkey.
