My Fiancee (petitioner)  has a 3 kids but they don't live with her now.. she just lost the custody of them in  April.. and her kıds lives wıth theır father now .

She has been living  by herself for 5 months...

 

 what my  fiancee   needs to  put  her  Dependents  Information  Part  on I-134 ?

 

Does she include her kids on the

Form I-134 ?

The I-134 instructions are quite vague, so normally I defer to the I-864 instructions when there's a gap. The I-864 says:

"Enter the number of unmarried children you have who are under 21 years of age, even if you do not have legal custody of these children"'

 

As such, If it were me then I would list them as dependents.
