New revised travel ban and k1 visa for finance from Iran

Hi everyone,

 

Travel ban was revised just yesterday, two other countries were added to the list. My questions is, how does it affect the k1 visa from Iran. My fiancé is from Iran and I'm applying for a k1 visa for her. 

 

I have attached the new requirements for the new and revised travel ban.

When it goes into effect no new visas will be issued. Until further notice. Unfortunately :(

If, and this is just a question,  I don't know the answer,  she was able to legally move to a third country would she be applicable through that country or would she still be ineligible due to her Iranian passport?

She'd need to become a citizen of that country with a valid passport. She could then use that passport to enter/apply for the visa although all other and/or former citizenships must ofc be revealed in the application.

are you serious ?? Is that apply for ppl who lives in Iran or dual citizen too?:(

This time around individuals who were dual citizens and had Iranian citizenship had problems. I know there was a researcher that had a position at harvard or somewhere else that had issues.

I suspect the best bet for individuals with Iranian citizenship may end up being the longer/slower CR-1 process.

I'm sure that's possible, but takes years to become a citizen of another country. It will not be a straightforward process such as k1 visa (which is compelled to other visas, much faster).

Ok I am really not reading correctly obviously. Total ban on immigrant status visa's means Iran is going to be difficult period. I really misread that apologies.

K1 is a non-immigrant category visa, but it obviously isn't a F, M or J series visa.

As to the bonifide relationships part I have no idea. This would probably require some consulting with a lawyer to figure out.

Thank you but I just found this

(Nationals from these listed countries that have dual citizenship with another country not included in this travel ban will be able to travel to the United States with a passport from a country not on the ban list.)

Anyone knows  if these matter will be effect to the processing time??? special for ppl who are from one of these 7 countries  BUT are dual citizen??? because I remember in 2016 everything was faster than this year :(

This is from the CNN article I read

 

"The new order additionally provides consular officers with discretion to waive the new restrictions on a "case-by-case basis" if a foreign national demonstrates that denying entry into the US would cause "undue hardship" and he or she does not pose a threat to national security."
