Hi, I am also seeking expedition for medical emergency but haven't started the VISA process at all yet.  My husband who is a US citizen requires heart surgery, but also has not started the process on it.  He is afraid of going through it especially alone, and so my question is what do we need to provide as proof that he needs the surgery?  I'm trying to prevent delaying the process with letters requesting additional information or evidence.

How long can your husband wait for his surgery?  Even with an expedite, the process will take several months.   Depending on where you are from, getting a tourist visa to be with him during his surgery and recovery may be the better option, and filing the CR-1 spousal visa concurrent.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Is there any reason he has not started the process? Nothing to expedite until he does.

He was told months ago that he may need surgery if his condition doesn't improve.  He improved his diet and lifestyle and his condition did improve but recently it has got bad again.  I amn't sure how urgent the surgery is because he's being stubborn about seeing the doctor again and starting the process without me.  I can visit him and start the process but I am afraid of being declined entry for visiting "too frequently" before I attain the VISA.

We have only just got married and are currently filling out the forms.  I'm asking one question with regards to what will be necessary for when we attempt to expedite the process in order to prepare whatever we need from the doctor or otherwise.  I'm not sure why I can't get the answer to that before we have actually filed.

For a start, you will need proof that the surgery is actually needed urgently.

You will need to prove that:

- The surgery is needed urgently, and cannot wait, but at the same time can wait long enough for you to get through the visa process.  That I believe will be the most difficult thing to prove- essentially  "this is needed quicker than a year, but it can wait a few months until I have my visa".

- You NEED to be there to help him. Of course as his wife he wants you there, but is there compelling reasons why, other than love?  Does he not have other family that can drive him from the hospital, health insurance to pay for a home health nurse while he rests etc?

- Letters from (preferably several) doctors stating the surgery is needed, when, why, and you need to be there.

- Having just very recently married may be a red flag, especially if it happened after his diagnosis, as the government may think you two only married so he could "import a caregiver".  So be sure to document your relationship VERY well.
