Hi Everyone,

 

Good day!

I need your help guys, my fiancée and I will be starting our K1 and K2. I would like to know what are the requirements for packet then after that what are the documents that I need to present or prepare for interview once I approved.

The other problem is we have a child, I recently found out when I about to enroll my child in school  that his birth certificate is not registered. That time my fiancé are here in the Philippines (btw he's a Filipino) so we decided to go to Registrar to register our son. We want my son to come with me in US. Is there any possible problem that we will encounter since my son's BC is late registered? Will they ask for a DNA test for that? Please enlighten me I'm so confused right now.

I suggest you reading the guides and timeline flow charts for the K1 visa, it will give you a lot of information to answer questions you may have about requirements and the process as a whole.

 

I'm not sure about the BC but as long as you have one, I can't imagine it would be too much of an issue.

However, please note that form G-325A is no longer needed ever since it has been incorporated into the new I-129F. Also, the current filing fee for a I-129F is $535.

 

Download the latest form I-129F at https://www.uscis.gov/i-129f.

 

Late registration of your son's birth certificate shouldn't be an issue as long as it is officially registered now before you start your I-129F/K-1 & K-2 as a copy of the birth certificate needs to be submitted at one point or another. So far, I haven't read anything on here that talks about a DNA test, exactly why would they ask that from you or your fiance?

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Right of the bat I just want to congratulate you for making the decision of petitioning for your fiancé and your child. I may be able to provide you with some info to get you started in your process.

 

First of all, you should really take a moment to reflect on the whole process. Applying for a K1/K2 Visa is an inherently complicated process and at times it can be really frustrating. The process takes a lot of patience, time, waiting, money, forms, more forms, trips to various government agencies, etc. However, you are doing this for a good solid purpose -- to be with the woman you love and your child. So take a moment to plan ahead for the future. I say future because the whole process can be extremely lengthy if you do not plan accordingly. 

 

I am currently in the process of petitioning for my wife and baby daughter. My baby daughter's application took just 3 weeks. However, I have yet to hear from the National Visa Center regarding my wife. I petitioned for my wife in October 2016 (CR-1). The main reason for the time difference is that I filed a Consular Report of Birth Abroad for my daughter (She is only 4 months old). It was fairly simply to gather all the necessary documents since she is just a baby. Older children will require further documentation (i.e., school records, proof of paternity, doctor notes, etc.). I mention this "two bits" of information about myself just so you can get an idea of what to expect. Although an CR-1 and a K-1/K-2 Visa's are inherently different by definition, the initial process is very much the same.

 

You will need to start gathering as many documents as possible. At the core of the initial application is: identifying who you are and who you are petitioning for. That is: You (Joshii) are petitioning for your Fiancé (insert her name here) and your Child (insert name here). It sounds straight forward, right? But it requires a bit more effort than just that. To do this, you will need to fill out the appropriate forms (K1 Visa) for your wife, and a CRBA for your child (assuming that you are a citizen of the United States). Otherwise, you will be filing a K1 Visa application for your wife, and a CR-1 visa application for your child. 

 

Included with the forms you will need to send photocopies of your passport, (2) passport photographs for each application, a copy of your identification, and a few other requirements. For your Fiancé you will need to provide a current copy of an unexpired Philippines passport, a copy of at least two (2) government issued I.D. cards. For your Child you will also need to provide similar documents. It is very important that you have at the very minimum 3 copies of all documents (between both applications). You will need these at some point. (I speak from experience)....

 

Next, You must spend some time reading all the instructions. There is absolutely no way around this. 

 

Moreover, you really need to think of a way of staying organized. Remember how I mentioned that my baby's application took only 3 weeks? (Hint hint). I recommend that you get yourself a flash drive that is used solely for this purpose or if you are traditional get yourself a planner that you will use to write down everything. You should spend some time each week writing information in this planner. Treat it like your bible. I really cannot emphasize enough how important it is to write everything down and to stay organized. This is my golden piece of advise.

This is not entirely correct.  For the initial petition phase for the I-129F, no picture ID or passport is required from the beneficiary. 

The only thing needed from the beneficiary to send the petitioner is a current passport photo and a signed and dated letter of Intent To Marry.

Nope I don't see a problem with late registration. That happens often in the Philippines. You just register it and get an NSO certified birth certificate/late registration.

You are the beneficiary, correct? As a beneficiary you will need to go through a medical exam which will be sent directly to the embassy. You will also need your birth certificate on NSO paper, NBI clearance and police clearance from all the countries you have resided in for more than 6 months after the age of 16, CENOMAR (Certificate of no marriage) from NSO, Affidavit of Support from your petitioner (I-134), and evidences of relationship. That is some of the important things you will need. But it will also depend on the embassy if they will require additional documents. You will receive a checklist of their requirements in the mail when your approved application is sent to them by National Visa Center in the US.

 

For now, since you are at the beginning stages of the K1 process...your fiance (petitioner) will be doing all the work since the application will be needing information from his end. You can contribute by sending him evidences of your relationship like pictures, chat logs, phone calls, etc. More detailed information is found here:

My wife, a Filipina never had a birth certificate until I met her.  She was 19 years old.  She had to go to Surigao (from Cebu City) 3 times to finally get her birth registered and her birth certificate.  About a month after getting her birth certificate we were married in the Philippines.  A month after that we filed for her CR-1.  At the embassy interview in Manila they asked why she never had a birth certificate until just a few months ago (I think they called it late registration) and she replied that she comes from a poor family and they just never had the funds to go back and forth to Mindanao.  This was the truth and the CO was satisfied with that answer.  F.Y.I: These CO's are highly trained to read body language and they are pretty sharp at observing someone that is not being truthful.  Always remember, honesty if the best policy.  Never lie to a CO.  I am not accusing you of lying but I am reassuring you that as long as you tell the truth you should be fine.  I don't think you will need a DNA test as long as you and the father are listed as the parents on the birth certificate.  Good luck and God Bless the three of you.  David

Do I need to attach CENOMAR for I-129F?

I believe that's needed at the embassy stage.   That is something specific to your country.
