Why did my fiances case got sent back to USCIS after his interview in Kabul?

You are right. I have got just the same problem in US Embassy Abu Dhabi - UAE. and they put me in the Administrative Processing. Actually, I did not get deni. Just the Consul written on the 221 (g) paper Revocation/for Immigration benefits only. The Consul was really awesome man. He helped me a lot.

revocation for immigration benefits only        THAT MEANS THAT THE CONSULAR OFFCIER THINK THAT YOU ARE USING THE USC TO GET PAPERS TO GO TO USA, so that means that you are denied, google the word revocation for immigrant benefits only and you will find the answer.

they didnt that your relationship is real for that they send the case back to uscis, you are denied, once the case is sent back. even if you see the status on AP, the usc will get a letter saying that the case is automatly closed, no reson or explanations.

No, this is not correct. Your petition was also refused and will be or has been returned to USCIS for revocation.
It will expire and you have to file again.

Yes, even though the letter says your petition will be reviewed by USCIS it will not. Returned K1's will be purposely expired and in 6 months you will get a letter stating that it is expired and that you can file again. You can either re file a K1 or marry and file a CR1. Overcome the reason for the refusal with frequent visits and lots of relationship evidence in a front loaded next petition. No lawyer needed. The embassies are inefficient and irresponsible to still crank out these letters stating it will be reviewed. Spousal cases get a review but not K1's.

So wair a in a minute so why are they telling you that a wait for a decision letter clearly says and my senator says either two things going to happen they're going to find out within the 180 days if it's a bona fide relationship and if so it will go back to the country and he will obtain the visa or if they find that it's not a bona fide it's going to be denied then you would have to apply all over where you're getting your facts from.plz is very urgent thanks

Ok but does this mean i have  to first wait until six months that it's expired and then I can file for a CR1, or can I do that as soon as possible ? Because if this is what it is i want to plan to go see him asap and marry him asap then come back to new york and apply for cr1 

what do you advise? Is that a wise move?

you dont need wait for the letter, the letter only will say that the case is expired and close.

if you want apply for a new k1 you can or you can go and get marry.

1. Who is THEY

 

Whoever tells you whatever is going by an outdated template letter.

Tell your lawyer that only spousal cases get a review NOT fiance visas.
Then fire him and go without a lawyer or find one that actually understands the K1 return process.
Your senator's aid also doesn't know what they are talking about.

 

Do your research so you know what is going on, there are hundreds of threads here.
Your K1 will not be reviewed, it will sit in storage and expire.
6 months from now you get a letter from USCIS stating that it has expired.

Then you file again, either another petition for a K1 or marry and file a spousal visa, CR1.

 

You can send your embassy a complaint letter if they told you USCIS will review it.
Tell them to update their templates and stop inserting names and case numbers into outdated general structured
templates. If they told you it will be reviewed then they are wrong plain and simple.

 

IF your case is in AP at the embassy and has not been returned ( which is not your case from what you posted ) then
they will do a review at the embassy but under a 221g.

You can marry as soon as tomorrow if you wish and file the day after tomorrow.
No waiting needed.
A CR1 overrides a returned K1 in process and you will be asked questions in the forms regarding the previous petition so
they will know your K1 has been returned. Attach the return letter from the embassy with your new petition.
Front load your next petition with lots of relationship evidence so that won't be returned too.
If a CR1 gets returned THEN it will be reviewed because it is a spousal visa.

If you want more details yourself, lookup P6C markers. When a K-1 visa application gets refused for lack of a bona fide relationship, the CO sends the case back to USCIS with a recommendation to revoke the approval of the I-129F petition. Previously, this P6C marker would be reviewed by USCIS and if USCIS agreed, it turned into a finding of fraud.

 

Instead, USCIS just lets it sit to expire - bypassing the potential fraud finding and letting you refile or marry and do a CR-1. Anyway, this revised workflow has been in place for the last several years now.
