This gentleman is here asking about his case. What he was, or was not thinking, isn't germane. VJ is a place to get assistance and ask questions, not have your character judged. Whatever we might think about the situation, what happened is between him, and his fiancee. And USCIS. They may judge, but it isn't our place to do that.

 

OP: You absolutely need to tell her the truth, and you absolutely need to tick the box inquiring as to your arrest.

I can explain it to you. But I can't understand it for you.

They may ask her when you told her about the arrest, as has happened for those who are convicted of other offenses. The fact that you didn't tell her right away might weigh into their consideration at the embassy. She has to be completely honest with them and may be asked to described how and why she got past what you did/intended to do. 

 

I think you have to talk to her first, to know if there will still be a petition to make. 

 

It might be best to wait on the petition and tell her, have some couples therapy to ensure you are both on the same page going forward, then proceed with immigration thoughts.

Your "past mistake", as you like to call it, may or may not affect your application. However the CO who interviews your fiancée will not be happy if you have not been honest with her. They are required to make sure that fiancées are aware of any past criminal activity of the petitioner. A bona fide relationship is one based on honesty. If I were her, it wouldn't be the arrest that bothered me, but the deceit on your part not to tell me. 

 

My my husband has a felony and although I was fully aware of this from the early days of our relationship I was questioned about it at the embassy. And this was for a spousal visa where the IMBRA rules do not apply. But still the CO was concerned that I should be fully aware.

100% disclose yes. That is tick the box yes to arrests plus include all copies of the case disposition, not just the court record. Disclose to your Laotian Fiance before you submit in case she has second thoughts about the relationship or put things on hold. That way you are not out of $$ for the application.

 

Both USC and the foreign born fiance(e) are subject to rigorous checks by USCIS and State.

The biggest thing for her should be how many times you did it and didn't get caught, what assures her you wont do it in the future.  To be honest with you and I am sorry to say this, but if she takes it well and doesn't seem bothered deeply by it, then she doesn't love you.  Either way, good luck and I hope you get it worked out with her without being concerned with this visa.

You need to get it fixed. Contact the embassy, it should be an easy fix.

You definitely shouldn't buy your ticket until you get the visa and verify it's all the information is correct. For that very reason!  If I were you I'd try calling the embassy and speaking with someone, I have no idea it would take to get a new one printed. I wouldn't think it would take long, but you're definitely leaving soon.
