Can anyone please tell me after the marriage how long we have time to submit the I-485 form and how much it's cost.

When adjusting from a K-1:

 

I-485 = $1140

Biometrics = $85

I-131 = $0

I-765 = $0

 

Total, one check in the amount of $1225

 

There is no time limit, but file asap after wedding, preferably before the i-94 expires. It's not a requirement though, you can file later as well.

You have to check that with your local DMV. Every state has other requirements for non US-citizens on how to obtain a driver's license.

Here in Georgia for example you need a valid EAD in order apply for a DL.

Check with your local DMV, as every state/county is different! 

 

I believe from previous discussions, the drivers license is only valid till the date on the I-94, you will then have to renew it once you receive the EAD (or Combo Card).

 

But again, it is always best to check with your local DMV (Especially in terms of ID requirements).

Hi we are in the same state - so we have the same regulations in regards to Driver's license.

Option 1. You can apply right away using your foreign passport and unexpired i-94 (you need your passport + i-94 + social security card + two proofs of residence i.e. mail with your name on it to your current address or your name on the lease, no more than 90 days old.) IF you manage to do this before the i-94 expires, the license will expire when the i-94 does. License will be in your maiden name.

Option 2. You apply when you get your NOA1 (i-797c). You need the same documents plus your NOA1 plus marriage certificate. If you do this, you might have to convince the DMV personnel that they should use your "foreign passport" as verification document and scan ALL other documents when trying to verify your lawful status. License can be in your married name - again you might have to talk to a supervisor, many are unfamiliar with the process.

Option 3. Wait until you get your EAD - The EAD will be used as verification document - You will likely not have any problems - most are familiar with the EAD being a primary ID and your license will be in your married name - all same documents required ofc.

 

TIP: NOA1 can also be one of the documents used for proof of residence. You are allowed to use your foreign driver's license for the first 90 days (police will allow you to drive longer - 6 months- if pulled over, but 90 days is the "official law".

oh and there's no set time for filing AOS. You just need an official copy of the marriage certificate (from the town hall/registrar), so as soon as you have that and have all the other documents, you can send it. The earlier the better.
