Name change and official documents

I arrived in USA on a k-1 visa and I'm marrying my fiancé in a week. I wanna change my last name to his but if I do so, do I need to renew my passport before applying for adjustment of status? Can I use my passport with my maiden name to apply or do I HAVE to have my new name on it? I called USCIS and they said I would need to get a new passport with me new name but looking through forums of people with similar problems is confusing me.

 I have a similar question, though my passport is expired. Do I have to renew my passport first before I apply for AOS? Or it doesn't matter? Thank you

You can definitely AOS without a new passport, that's how "everyone" does it. 

 

Getting a new passport in your married name can be good for other reasons though. I got mine a few months after I moved here as I felt safer having it in my married name in case I have to travel etc. I still haven't got my EAD so I can't get a state ID, meaning my passport is the only ID I have. 


K-1: 12-22-2015 - 09-07-2016 (260 days)

AP: 12-20-2016 - 04-07-2017 (108 days)

EAD: 01-18-2017 - 05-30-2017 (132 days)

AOS: 12-20-2016 - 07-26-2017 (217 days)

 

ROC: 04-19-2019 earliest filing date

Alright thank you! Yes I will probably get a new passport with my new name in the future. But I'd like to save as much money as I can for the time being, since I don't have a job yet. Applying for a work permit with my AOS. Thank you very much!

By the way, can I change my whole name or just my last name?

You can use your old name perfectly fine. Remember to write folkeregistret i København and tell them about the name change and that you are married. To get the new passport your new name on GC have to match the name in the DK database.
