Affidavit of Support I-864

Hello,

 

I'm petitioning (I-130) for my husband and we both live and work outside the US. Salaries here are much lower than in the states and I have seen they like to see about 125% above the poverty level. My question is if living abroad with lower salaries would greatly affect us when we reach the affidavit of support stage. I'm considering moving back to the US to look for a job so we can hopefully avoid issues with this. Any advice or suggestions are welcome!

They not only "like", they require you to show income above 125 % (or at least 3x that amount in assets). Foreign earned income that will not continue upon your return to the US does not count at all towards this threshold. You'll need to find a US based sponsor, or return to the US and gain employment.

I should have added that my father is a joint sponsor and has earned well over the 125% above poverty level for over 25 years. However, since I am the petitioner filing for my husband I didn´t know if my income had more impact than that of the joint sponsors.

A joint sponsor is only required when the petitioners income is insufficient, so you will be fine in this case. Make sure that you are up to date on filing US taxes for the years you've spent abroad.

Your income overseas doesn't count. On your i-864 it will count as "zero" as it's not income available to you when you relocate to the uSA.  The only people whom this would differ for is those working abroad for a US company, who pay them in US$

 

We are in this situation where our income is all foreign so we are applying based on "assets", in our case savings accounts and bank balances, which have to be 3 x the poverty line for our house size (myself, husband and our daughter).  The other option is having a sponsor, someone in the USA who meets the minimum requirement and is willing to "be responsible" for you should you become a burden on society and so on.
