Hi we sent our application April 1st I was here as I came to visit and help fill the application. I'm here until June as I'm allowed to stay 90 days using my ESTA visa. 

You can visit as long as you have the correct visa and don't overstay your allowed time. Also have your return flight booked and I always have proof of this to show at border control.

Ah ok cool. Thank you 😊😊 I'm travelling on my ESTA and have return flights booked. I'm only staying for 10 days but I was also gonna bring my NOA1 and letter from my employer stating the date I'm expected back. Hopefully it will be fine 😊

Does any one know what type of visa the K1 applies for?  just wondering since eventually we need to apply for it. That is soooo confusing. lol  Is it a nonimmigrant visa or an immigrants visa?

Non-immigrant Visa with immigrant intent and benefits, which is the reason why at some stages of the process you'll find it under the immigrant visas section (ceac/NVC and Embassy).

Passport photo of SO is not exactly 2x2; I typed, cut, and pasted notes behind the photos; my cover letter had birth certificate/passport yet I sent a copy of naturalization certificate. I'm putting it to the stars and the universe, like I do to many things I am not in control of. Good luck to all of us!

Hello you :) Welcome to the April filers family.

 

I'm sorry to hear about your trouble with the petition. Anxiety is a common thing around here. I think the only thing that should be a real concern is the passport picture, since the rest is something that any person with a bit of common sense could understand and not send you an RFE for. Then USCIS is not known for their common sense :P

Regarding the passport pictures, I think that might also depend on the officer reviewing your case, but you can always get 2x2 pictures beforehand  and have them ready in case you get the dreaded RFE to send them back ASAP.

 

Anyway, don't suffer too much in advance, because this can be a long wait and already a nerve wrecking process as it is.

Hi! I just visited last week and had no problems.   I specificially said I was visiting my fiance and they never asked for any evidence I had that I was coming back (return flight booked, letter from employer).  They did question why I had 100 lbs of luggage but I said I was there for almost 2 weeks and also had some camping gear on me (which was true).  I was still a bit worried though but I hope if they see you are doing it legally and that you MUST return home for the interview, everything will be fine :)

Thank you so much for your reply! That's what I'm thinking, surely they'll understand we wouldn't waste money of filing the I-129f if we weren't going about it the right way. I just get so nervous because I will be so upset if I don't get to see him lol :)

The visa is called a K1 visa.  Like others said, it's a non-immigrant visa with immigrant intent.   When it gets to the point of filing the visa application and scheduling your appointment, you complete the non-immigrant application (DS-160).  When you schedule the interview appointment, you select immigrant visa and it will give you the option to choose K1.
